An ‘Official sensitive’ document obtained via the Freedom of Information Act has revealed more of the DWP’s timetable for the forced move of legacy benefits claimants onto universal credit (UC).  It appears that most claimants will not begin to be moved until the winter of 2023.

The document ‘Move to UC Monitoring and Evaluation Strategy’ divides the move into four phases leading up to the full national roll out of forced migration. 

 Phase One - Discovery

April-June 2022

Small numbers only

 Phase Two – Scaling

June 22 to January 23

Minimum 1,000 claimants

 Phase Three – Scaling

Spring 2023

Minimum 5,000 claimants

 Phase Four – Rollout to national scale

Winter 2023

100,000+

 

Except for an unlucky group of a minimum of 6,000 people, it seems that most legacy benefits claimants are unlikely to be affected by the transfer before the winter of 2023.

However, after that the process will have to go at an extraordinary pace if all 2.6 million affected legacy benefits claimants are to be transferred by the end of 2024.

Each phase is intended to gather more information about such things as how well vulnerable claimants are identified, which groups fail to respond to migration notices, which groups come off benefits altogether and what happens to them.

Claimants will be monitored from the point at which they are asked to move to the time when they are on UC, have been paid and their conditionality regime has been established.

The DWP say that they will be carrying out in depth interviews and large scale surveys as well as ‘tracking claimant interactions using Smartphone Apps’ in order to capture the full range of experiences of claimants undergoing the transfer.

The DWP clearly expect a number of claimants not to make the move because they say that:

‘Research will also be undertaken with a sample of claimants who choose not to make a UC claim to understand what has driven this choice.’

The fact that these may be some of the most vulnerable claimants and that they may not want, or be able, to have a dialogue with the DWP does not seem to be a particular concern.  And the fact that only ‘a sample’ will be contacted is a real cause for concern.

The benefits affected by forced UC migration are:

  • Child Tax Credit
  • Housing Benefit
  • Income Support
  • income-based Jobseeker’s Allowance (JSA)
  • income-related Employment and Support Allowance (ESA)
  • Working Tax Credit

So far, selected claimants have received a migration notice in:

  • Bolton
  • Falmouth
  • Harrow
  • Medway
  • Truro

    I reach State Pension age at the onset of winter when my ESA Support Group eligibility will stop, as it is an ESA 'legacy benefit' that I receive (.. unlike those who receive New style ESA, who are eligible for a percentage of their ESA to continue to be paid to them when they reach State Pension age) 

    As my health conditions are becomingbwirse I have been advised to apply for PIP before I reach State Pension age (as applications for PIP from pensioners are not allowed) 

    Also I have been advised that it would be best for me before I reach State Pension age to voluntarily change to New style ESA from the legacy ESA I receive, as then a percentage of my New style ESA will continue to be paid to me when I am a pensioner. 

    .. Does anyone have any experience of doing this? 
    - Of having voluntary moved onto New Style ESA, and what happens? 
    - As 
    I'm feeling daunted by the challenges ahead. Any advice appreciated, thanks.

      @Jane You cannot claim state pension and esa at the same time,esa is a working age benefit. However if you’re eligible for a standard daily living pip award you may then qualify for a pension credit top up

    I wasn't able to cope with the mental health problems being forced to reapply for my dla for life award when they decided that I have to apply to PIP five years back so I lost my mobility car,my upgrades to esa eg sop etc.
    I'm now left with £70 per week esa and am unable to manage financially and have also lost eligibility  for dis bled travel passes etc.
    If I have to apply for UC I will be put in an even worse condition - I can no longer cope with the severe stress and upset and anxiety caused by applying for claims with the dwp with the system as it is.
    No one from dwp ever tried to discover why I hadn't  been able to apply for PIP and I feel that part of the out come dwp want is to " loose" claimants and save money . They ll be thrilledwhen I starve or die of hypothermia like others in my position.
    I am terrified about the future.

      @Thos Nichols Hi Thos. Thank you for the links and advice :-) I was actually told by my 'work coach' that I needed an advocate! They could not believe I was put in the WRAG group especially due to my incontinence, (sorry) and severe anxiety!! I still haven't appealed since 2017, as, it is still 'too much' for me to go through another MA! Especially as the last one, was carried out by, a paramedic! What do they 'know' about nerve damage to base of spine? It's sickening!

      @Billy Carling Billy I feel just like you. I don't know which way to turn. I don't understand all the terminology re benefits. I'm on ESA and in the support group. My health is worse but not contacted drs because a) there's no point and b) I have no idea where to start. I have so many problems I'd need an hour to speak to the Dr, and they barely give you 10 minutes and the idea of talking on the phone is anathema to me as it just makes me really anxious. I've no idea if I would get UC. It worries me constantly, as I don't have any up to date medical papers. It would be pointless anyway ad all I get offered is pain killers. I hate my life and don't want to wake up...

      @Billy Carling Billy, I can relate to your situation as I was receiving DLA and went through four PIP applications before being successful. The final route I chose was one of the organisations that handle the whole claims process right through to Tribunal representation if that is required. They charge a fee but I believe they are worth every penny. You can find these organisations if you search on Facebook. Best Wishes.

      @Billy Carling Hi Billy - I really hope things have improved since you wrote this, it sounds a very tough situation. Have you heard of Advocates? I was supported by an absolutely brilliant advocate through both PIP and ESA appeals, including a Tribunal... at which the judge threw out the DWP case and my awards were set at higher rates. Like you, I couldn't face the thought of going through months of this wrangling when I was feeling so unwell, but with an advocate the process became much more straightforward. 

      If you google "dwp claim advocacy" you'll find various people advertising their services - sadly the chap who helped me is currently unavailable. There's also a really helpful list of services at Disability Rights UK:

      Some of these will I think make a small charge, but only if you win your case. If you are only receiving £70 a week instead of the appropriate ESA (or UC) and PIP awards then this charge will pay for itself possibly in a week.

    This is a disgrace but typical of this Nazi government!! Things have got worse under Truss and I didn't think that was  possible but sadly it is. This is the worst government this country has had in my life time and I am 65 so have seen quite a few. WE NEED A GENERAL ELECTION NOW!!!!!!!!

      @Corinne Absolutely agree, Corinne. I'm 63 tomorrow and in despair. Never in my lifetime did I expect to reach this age and be living in absolute poverty. My parents had a better standard of living in their old age, because despite being poor they didn't have to worry about massive energy bills, food costs and petrol costs. They had also bought their own house, despite it being a struggle. Since 2012 life has gone downhill as fast as the current fall of Sterling, and I honestly can't see a light at the end of the tunnel. When you live in the 6th richest country in the world, but can't afford to put food on your table and don't qualify for the 'local' food bank because your postcode does not fall in the catchment area, it is a pretty bad state of affairs. There is little left worth living for.

    ESA support group who cannot work and  having to go on UC will be confused with no respect and eventually the Goal for government is to get rules that those people to do some kind of work even tho they can't do any kind of work for many years as illness, disability stops them. Again they will lose money as it's so complicated the switch over from ESA

    Once transistional protection is eroded I will lose a THIRD of my previous ESA amount. And with the high inflation rates, missing out on uprating & having to pay 100% of my rent rises that's going to happen really fast. Where is the outcry about this? How are we supposed to cope losing so much of our income? Do any of the MPs know they are doing this? Do there own MPs know this?!

    Nasty party at it again.  Mini Budget for the rich not the poor, it was obvious how this was all going to pan out.

    No more windfalls of the gas & elecy profit leeches, coz truss is too afraid it will cause a problem with UK growth !!!!

    If truss really wanted to help the poorer people in the UK, then she should had made sure these energy profit leeches could not make us pay any standing charges.  In fact the same with all utility standing charges.

    She could had also stopped the BEDROOM TAX.  And there's tons of other ways they could had made this cost of living easier for us.  But no they have create a bigger class divided nation, i.e the poor and the rich.  The rich fat cats getting richer off the back of the poor people of Britain.

      I agree completely. We are nearer to the Victorian Era than ever before.
      I actually believe a plan is in play and is the same plan they have used before. Since becoming disabled and body fairly useless I’ve seen a pattern???

      It is 2 yrs before gen election. Tories know they’ll lose leadership.
      So, they reap every penny possible 4 themselves/push into all mp businesses and friends/relatives pockets. They do all they can to make the poor destitute. They strip nhs and public services to bone yet personally invest and install as much as they can into private sector. They research all the areas that could be employed by Other parties +invest/place those. They aim to leave the country in a terrible financial position thus Labour inherits a near- impossible task. They hide/delay figures so pretend country looks better than it is.

      Election—-Tory lose to Labour. The country, all financial pots near empty, so in a real state-facts & figures of how bad it is only comes to light later, &during the labour time in gov. Tories rant that straight away labours efforts have already damaged country hugely(not true but headlines make it look convincing !)
      Recovery of country is almost impossible but slow changes improves things for lower earners first. Tories continually berates Labour.The rich have louder voices as afford big adverts, publish press articles etc.  publically twisting every decision to make Labour appear worse than they are. False accusations of Labour behaviours has been known to slur party and distract public. Promotion /development of programmes about benefit cheats, & disliked community eg:travellers, programmes about street crime/drugs/violence all promoted to be screened. This erodes cohesive community and frightens people who then believe it has all increased during labours time in office. =Fear mongering.
      Labour tries its best but they don’t have the network of greedy fat cats/££etc. When companies are called upon in predicted areas, tory invested companies are poised to respond. ( get contracts-often failing to perform)
      This continues to next election. Tories hope to win by stressing Labour has “under-performed” (conveniently forgetting the dire state of things when they took over)plus feeling of community is eroded & public anger is widespread.( as demonstrated by tory encouragement!)

      Next Election… if tory win, they reverse all good done for lower earners, vulnerable/disabled.U-turn taxes on rich & revert Labour policies v quickly. 
      If Labour win tories keep up the publicity to disintegrate “communities” & suppress public mood.
      If hung parliament/alt  party win, tories continue to disintegrate the good done and plan for later victory so that Joe public duped so all other parties seem incompetent.

      We have been in this cycle for years. Rich areas kept rich. Poor areas recover somewhat but never will it reach balance. Tories remove money from circulation into private investment covering all areas of possible gov contracts to keep personal incomes huge.
      Until MPs and PMs are elected only on Merit of skill and NOT on status or Elite schooling then country IMO is doomed. Imo, MPs should NOT be permitted to have active investments. Assets should be frozen & set then unfrozen when no longer in government with any £ made during political career donated to charity for NHS or education.

      Alistair cambell said yesterday these 12 candidates on TV “ finding a ‘PM’ “ programme has 3-4 very very strong entrants who could indeed make very effective Prime Ministers, I believe this could actually be a better way to find our future electorate!! And perhaps then & only then we could feel of value and receive a proper consistent benefit that allows us a fair amount to live on. Without the undue stress, the hell of anxiety, months of reading writing and planning for the DWP hoops.

      @MrFibro I've always wondered why if there has to be a standing charge, it couldn't include a very small amount of electricity included on a daily basis [stopping you using it all at the start of a billing period] so poor people's freezers never go off due to running out of credit. It might also cover one or two light bulbs for safety. This would avoid the loss of precious food in the freezer and help people eg freeze giveaway or reduced food. And save people risking falls in the dark or fires started by using candles.

    One of the Tories greatest victories of the last 12 years, managing to force through Universal Credit. And in doing so destroy the existing benefit system. Despite the huge cost of UC, its many flaws , and harsh conditions.

    yeah i read that mini budget thing today, tighter restrictions on UC claiments while in the same mini budget they said that a bankers bonus limit that was planned is to be s crapped, yet agai ntories looking after the super rich and screwing over the poor, like seriously who votes for this party

      @angry person The tighter restrictions is mainly aimed at those already is work. So now if you work less than 12 hours (will be 15 by next year) you stay in the work search group rather than going to light touch.

      @Jason lee Yes i get EDP and SDP due to being physically disabled and was mental health issues that was found to be with autism when they deliberately denied me support pip for 14 years till i had a mh crisis that got me sectioned. I was 52 when diagnosed. So they said i have to ring up about EDP Compensation when we migrate to UC. So when it all balances out i loose £140 a week. I get the EDP because technically i should have a carer but don't get one and I'm single. And on PIP enhanced. I do have to pay extra for things that require a hand as i don't socialise and i have prolapsed degenerative disc disease and OE, and other issues. They underpaid me for 3 years. And i got it back dated as it was due to their clerical errors. But 0 compensation given inflation went up about 15% at least during them 3years so I've lost £1000+ Of value in the money not to mention the 14 years they tortured me on esa only with no travel pass. And denial and impacts to my MH. They do not care.
