WCA abolition and  new UC health element FAQs

We've published some UC health element FAQs here.  The most important takeaway at the moment is that it's likely to be - at the very least - 6 years before existing UC/ESA claimants are affected. 


 

When will changes happen?

They will be rolled out geographically for new claims first from 2026/27 to 2029.  Only then would existing claimants begin to be affected.  There will be some transitional protection for claimants who have LCWRA but do not get any element of PIP.

"The degree of change in our proposals will require primary legislation, which we would aim to take forward in a new Parliament when parliamentary time allows. These reforms would then be rolled out, to new claims only, on a staged, geographical basis from no earlier than 2026/27. We would expect the new claims roll-out to be completed within three years (so by 2029 at the earliest), when we would then begin to move the existing caseload on to the new system."

New UC Health Element

The UC LCWRA element will be replaced with a new UC health element for claimants getting UC standard allowance and any PIP element.  Paid at same rate as LCWRA element.

"Landmark reforms to the benefits system will change the emphasis from what people can’t do, to what they can, by legislating to remove the Work Capability Assessment (WCA) so that in future there is only one health and disability assessment – the Personal Independent Payment (PIP) assessment.

"This will mean there will be no need to be found to have limited capability for work and limited capability to prepare for work to get additional income-related support for a disability or health condition – reducing the worry claimants currently experience that they will lose their benefits following a reassessment.

"We will replace the current Universal Credit Limited Capability for Work and Work Related Activity (LCWRA) financial top up with a new UC health element. This will be awarded to people who are receiving the UC standard allowance and any PIP element. The award rate of the new UC health element will be set equal to the current award to those people that have LCWRA, ensuring there is a safety net in place for the most vulnerable."

Sanctions

"The next set of employment reforms affects those on universal credit without a health condition who are looking for work or on low earnings. There are more than 2 million jobseekers in this group, more than enough to fill every vacancy in the economy.  Independence is always better than dependence, which is why a Conservative government believes those who can work should.  So sanctions will be applied more rigorously to those who fail to meet strict work search requirements or choose not to take up a reasonable job offer.  And for those working low hours, we will increase the administrative earnings threshold from the equivalent of 15 hours to 18 hours at national living wage for an individual claimant.  Meaning that anyone working below this level will receive more work coach support alongside a more intensive conditionality regime."


Universal Support

"Today I’m going further than that by announcing that in England and Wales after listening to representations from the Centre for Social Justice and others we will fund a new programme called Universal Support.  This is a new voluntary employment scheme for disabled people where the government will spend up to £4,000 per person to help them find appropriate jobs and put in place the support they need. It will fund 50,000 places every single year."


 What the chancellor said

"I start with over 2 million people who are inactive due to a disability or long-term sickness  . . . we could fill half the vacancies in the economy with people who say they would like to work despite being inactive due to sickness or disability.

With Zoom , Teams and new working models that make it easier to work from home, this is possible now more than ever.  So for that reason the ever diligent work and pensions secretary today takes the next step in his groundbreaking work i9n tackling economic inactivity.  I thank him for that and today we publish a white paper on disability benefits reform.  It is the biggest change to our welfare system i9n a decade.

His plans will abolish the work capability assessment in Great Britain and separate benefit entitlement from an individual’s ability to work.  As a result, disabled benefit claimants will always be able to seek work without fear of losing financial support." 


WCA to be abolished

The chancellor has confirmed that the WCA will be abolished


 

Prepayment meters

Prepayment energy meter customers will have charges in line with direct debit customers in the future, rather than having to pay a premium.


Energy Price Guarantee

The Treasury has confirmed that the Energy Price Guarantee will be kept at £2,500 for an additional three months, from April to June. The government claims this will save the average household £160. It's a small improvement, but many are arguing it doesn't go nearly far enough in supporting people on low incomes with their energy bills.


What we're expecting

From the information that has been put out by the Treasury so far, the main issues that we will be looking out for are:

The abolition of the work capability assessment (WCA).

An increase in the severity of the sanctions regime.

Sanctions being issued automatically by DWP software.

The potential abolition of the WCA raises a huge number of questions about how it will be decided whether claimants with health conditions will be subject to the sanctions regime and whether and how they will be assessed for any additional payment because of their health condition or disability.  We hope the white paper will have some of the answers.

    the most worrying thing for me is: 

    Can I be forced to do any work-related activities if I get the UC health element?
    Yes you can.

    If you are receiving the UC health element you may be set both voluntary and mandatory work-related requirements by a work coach and you will be subject to sanctions if you don’t meet the mandatory requirements.

    The DWP say they will introduce new “more personalised levels of conditionality and employment support, with the aim of helping people to reach their potential and live a more independent life”.

    At the moment I don't have any work related activities on UC as I came from the support group when I transitioned from ESA to UC. Will this change affect me? Sounds like it. Very stressful.

      @Ann wonder who will be paying the business telephone and computer services bills, and, home and buildings insurance as working from home as an employee will have business insurance ramifications me thinks? Most peole woriking from home use t be classed as self emoployed. But no doubt the morons have changed all this swifly to suit the 'high wage, high skilled economy.'

    I've just messaged a friend of mine to try to persuade her to claim PIP. She is in the category of being too mentally ill to cope with assessments so she chooses not to claim it, despite being so clearly in need of it. I worry so much about what will happen to her if she loses her LCWRA element of UC & is subjected to conditionality & sanctions. She surely would.not survive it as she is severly anorexic & would just starve to death rather than have to deal with them. This is such a badly thought out policy, or maybe it's deliberate...

      @Aw I hope you're able to persuade her and that she can get support with the claims process and form filling. Too many people fall through the cracks because of MH so you are obviously a good friend

    It would seem to me that this is another Tory attack on the benefits system and those who claim sickness benefits. They are now taking away medical assessment and putting the 'assessment' into the hands of non qualified medical people, 'work coaches'. So it seems as far as the Tories are concerned everybody in this country with an illness, however severe, can work. And if you don't take work the bots and work coaches will strip you of your benefit. So after 12 years of WCA, it is now 'work coaches with no medical training that will have the last word it seems.

    I wouldn’t be concerning about the DWP benefit changes yet. This will require primary legislation and as there is a general election coming up none of it may happen at all.

    Hi

    I don't know if its because I am stressed about all these changes, or that can not comprehend as well as I used to, either way can someone please help.

    I am in the ESA support group and I also receive PIP (enhanced rate).

    I also have a review in 2025.

    Can anyone kindly explain how this will affect me and will I still have to attend an assessment.

    In the meantime I wish you all well with these changes.

      @catoswyn That's not correct, anyone on the uc health element is required to have a work coach,there are no exceptions no-one is exempt,only maybe contribution esa claimants but no-one really knows what's happening there either,that includes me also ,and like all the posts I've just read regarding contribution based esa,it will probably be abolished leaving us who have working partners and no dependents with absolutely nothing unless we can get pip on its own, I've had ptsd,agoraphobia, panic disorder, oscillopcia,daily vertigo and migraine and severe swallowing problems since 1996,I can't work, that leaves us living on 21k year,my poor 5r Yr old husband who us now struggling with back oain and knee problems from working since the age if 16 very stressed st the thought of paying out everything on 21k it's not doable,it just isn't our home would be at risk.

    Lots of fine words in White Paper but would like to share my current experience of being a Benefits Adviser and numerous clients who have been found to have UC Limited For Work and treated by DWP staff as if the have Limited Capability For Work Related Activity.

    Many of these client who have been assessed as having LCW but get no extra payment and are supposed to be assisted and supported to get back into work have had no contact in some cases for months/years from their job coach. To be fair to local JC+ staff  we have a good relationship with them and when asked why no support they tell us that they are too busy with other clients.

    Comments part 2 are UK govt being mealy mouthed about reason for not doing a joint UC and PiP assessment ?

    As in Scotland this would have had to be a joint assessment of UC and ADP and would have to carried out by Social Security Scotland.

    Hell would freeze over before the UK govt would have agreed to this.

      @Silverstar Gosh! Long time since they transitioned me from DLA, also awarded indefinitely, to PIP. They wrote and told me I had to apply for the new benefit of PIP. Petrified at the time! There is no indefinite award on PIP so once you get it you have to do periodic reviews which is more stressful. There is nothing new here about that process so I guess it will just continue and eventually they will have transitioned everyone from old legacies like DLA onto PIP. Given how far behind they are with the people they have already I guess it may be a long time yet before that happens for you.

    Some comments

    Missed opportunity why the need for introduction of Adult Disability Payment in Scotland with all the cost and expense  - you have to ask why not a revamp of PIP along the lines of ADP which lready encompasses many of the proposed changes to PIP.

    Fascinated (concerns ?)  on proposed interaction of UC and PIP which will have to also apply to Scottish ADP claimants and will only work with closer, joined up working, cooperation, data sharing etc between DWP and Social Security Scotland. 

    As an example new UC Health Element 
    "This will be awarded to people who are receiving the UC standard allowance and any PIP element." So one assumes that in Scotland replace ADP for PIP. At moment PIP and ADP payment and criteria are the same but Scottish Govt want to look at revamping ADP

    Thank you B&W for providing an explanation of this White Paper despite the website crashing earlier today. I would like to say that I think that it is very unlikely that most of the the things in this White Paper, in fact I doubt that any of the things in the White Paper will come to pass ever. The Tories will not win the next election. Labour has got its own ideas about the welfare system, and I do not believe it will be taking any ideas from a Tory White Paper. So please stop worrying for now.

      @Cath So sorry to hear your news. I don't think you can claim PIP for the first time once you are state pension age and in receipt of a pension. You can only get PIP after state pension age if you were claiming it before you reached that age. You can claim attendance allowance instead which has different criteria and pays a lower rate (unfairly!) To get attendance allowance you just need to prove that you need someone to help you and be with you, ie attend you, for some reason. Think of the work carers do, or it could be someone to help get you out and about, or stop you from falling and so forth. You do not actually have to be getting the help - just have the need for it. Its best to get some advice from an experienced benefits advisor and the age related charities are good on things like attendance allowance, plus there are the cancer advice charities and as ever, citizens advice. I hope you get all the support possible. x

      @Cath I am so sorry to hear that you have a terminal diagnosis. Citizen’s Advice (assuming you are in England or Wales) says that if you apply for PIP, you will automatically qualify for that benefit at the highest rate. I should imagine that The CAB will also help you fill out this application too.     What happens to those people still on the old ESA support Group. That are maximum PIP both for personal and Mobility? My family have not yet been put on UC and have been told we would be better off on it. But I am not due a reassessment until 2025. I am on very strong medications and have mental health as well as physically disabled due to spinal problems long term.  The NHS still assessing me for possible A.S. Or other arthritis types ion my body as I struggle with arthritis in most joints in my body. I am becoming very concerned that I may end up being forced back to work in something that will cause my pain to flare even more. Let alone mess with my BPD. And PTSD which I only got six week of mental health support by the NHS. This has not helped but in someways pushed me backwards. I was better off when I was just hiding my problems. Except when I would have anger out burst and because of this I did loss a job. But now I am heavy medicated and am always sleepy and a bit forgetful. Nothing seems to interest me anymore. They keep asking if I am suicidal and I say that would be easier for others so no. I am here for the long haul. But even I get supper low when I can not play with my kids cause I hurt or am to tired out. But know we have the new budget to worry about. My wife says it’s all ok. But bless her she doesn’t think like me. I was once a warrior but now a drag on society. Sorry I am going down a rabbit hole.   
    Just hope this will not affect my family too much. As we have to do what is right to protect our own right?

      @D. Scott Spencer As someone who can also spiral into a state of high anxiety and depression I know how crap it is when these kind of announcements are made. I also have arthritis in most joints and sometimes am screaming with pain. Its so crap to be in physical and emotional pain long term. Anyone who suffers from depression and health problems like you describe is still a warrior - every day they get through takes guts. In my opinion they are some of the bravest people in our society. I am sure your family are proud of you for that and you can only do what you can right now. Maybe they can look to see if there is medication that is less debilitating and get someone to contact your local MIND or any other local support service for mental health to explain you have no real support for this and want some. Not just Talking Services. Its worth a shot. Elisabeth is right that changes to benefits will not be immediate and may not happen anyway in the long run. Your PIP will not be affected and currently those in the ESA support group automatically get the health element if they have to transition to UC and are not required to look for work. Hope this helps. x

      @D. Scott Spencer Try not to worry. Changes will take years to come in, assuming the next elected government goes ahead with them. Workers in benefits offices are overwhelmed with work already, they don't have the capacity to do anything fast.

    I am sat in a state of dread, fear & panic, i am in receipt of Carers A, Pip, Is. I have a severe anxiety disorder, agrophobia if I go too far from my house I also have medical issues! I also care for my Son! This is totally terrifying me that I feel I can't cope.! Always penalising those of us who's life is a constant daily struggle! It's OK for the Government sat in comfort and not a financial worry in the world! They aren't on our planet! I had a panic attack so severe earlier.. Thanks for that!!

      @Caitlin B I feel you, I’m autistic and feel anxious about it myself. I also have multiple mental health disorders and quite bad tinnitus. I’ve had to fight for so many years to prove I’m not well enough to work, then I’m ok for a while, then after face to face assessments they will also say they think I can work, then lose my job, then all of my benefits, so no income at all. I’ve been trapped in that cycle for so many years. I also had to appeal both my PIP and UC, which made me suicidal. Always the worst off that suffer the most every time.

    There seems too be sometime scale for all of this to be rolled out, how it will work I have no idea, I am on CB ESA, and mobilty only PIP, and I would not be eligible for moving into U/C so whatever help might be on offer by job coaches, will not apply to me, I will just I assume be cut off at the knees  and left with nothing, no help, and I suspect no income so my savings will be gone, as I will soon get through them paying for living expenses.  Thx Mr Hunt and Mr Stride, all out of touch and not living in our world.  I hope they are happy with what they have done, well I suppose they are if it looks good to their supposed voter base well it won't be me, and I wont vote for slippery starmer either.

    One thing I do want to say, B & W have not let us down trying to interpret and clarify the changes especially the time line. Though it doesn't make swallowing this easier it does help with some of the questions that have been worrying us all sick.

    They only focus on MSK and psychological issues when there are many on ESA   SG  with other conditions  that mean they couldn't hold down a  job,  And this BS about Working from home is fantasy land , We are living in Clown world
