Hi well after Months of worry Candice won the Appeal, Higher rate on both.
Shoulder never have come to this, this poor Lady literally went through Hell with relapse after relapse and you can all the evidence in the world and 3 reprisentives, the questions are directed at the claimant no one else apart for me got a word in, and it was close 14 Points and 12 Points We had it down as 28 Points on the Care Allowance, and the Representatives had even more!
, But on the day how the Panel directs the assessment. It's different to what I was lead to believe, in the manner of how the appeal is conducted.
Candice was so nervous she couldn't answer the questions asked by the medical person on the panel in a manner fitting with all the medical reports this so didn't help infact if she would have been asked her middle name she would have got it wrong, it was that bad, poor girl, I did butt in but was soon directed "Not At This Time" This is why the Care points were so low as to what we all thought should have been given, My point being The person Claiming Needs to some how be calm and collect Or they could loose. What is blatantly obvious in medical reports from many Professional Health Workers, from GP's to Specialist who carry out procedures ie Botox for urgency to name but a few, in this case it didn't seem to have a bearing it's all about answering the questions on the day " bit like a driving test you could be the best driver in the World, but on the day!" I Would advise someone close to submit a letter stating the facts and also take it with them Plus the most up to date medical reports on the day and give it to the panel, " even though they have already been sent in " I believe this is what made the difference as it was a close call, And this was the last things the Panel viewed ...It is very difficult and my heart goes out to people it really does. Really pleased for you and Candice, appeal hearings can be difficult but they do get it right the majority of the time.
