The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

Thanks for the reply Gordon.

The letter from the DWP is quite detailed and I agree with most of it - except for this one activity (of mixing with other people) where the DWP have awarded me 2 points for needing to be prompted by another person to engage with other people when I believe that I should have been awarded 4 points for needing social support to be able to engage with other people.

Should I phone up the DWP and re-request a copy of the HCP report before I send off a MR letter? I've already asked for a copy of the report on 13 October but have not received it. I have a feeling that if I phone up and make another request I could just be sat around once again waiting for something that may never be sent out. Or is it worth just sending off the MR and asking for a copy of the HCP report afterwards? I have an idea what I will be writing in the MR letter so I'm not sure if I need to receive the HCP report first. I intended to more or less send in a copy of the reply I gave in the PIP2 to this activity and add a bit more background information along with a request for the DWP to reconsider the points they awarded for this activity.

Also will the address to where I send the MR be the same address that is on the letter (which is Personal Independece Payment 9, Post Dandling Site B, Wolverhampton, WV99 1AG). And would you suggest I sent it by Royal Mail track and trace?

If you have time to wait for the assessor's report before you submit your MR request then do so, just make sure that the request is with the DWP before the month expires or you will potentially cause yourself additional problems. If you can get the report in time then it is worth your reading it, it may explain why the assessor did not think you needed Social Support.

You need to send it to the DWP office that dealt with your claim, so if this address is for that office then yes, use it.

If you can afford it then a tracked post is always best, but if not then at least get Certificate of Posting from your local Post Office (free).

Hi

I obtained a copy of the assessors report and have sent in a Mandatory Reconsideration and used the template that is in the PIP MR & Appeal Guide here at B&W. The MR was scanned on to the PIP system on 10 November.

Does anyone know how long the average wait is for the DWP to complete the MR? The lady I spoke to on the PIP helpline just said MR's are done strictly in date order byt couldn't give me an indication of how up to date the DWP are at clearing MR's.

I guess it's just a case of wait and see how long it takes and what the oucome is but my DLA stops this week and my ESA is going to be severely cut. I'm hoping I hear something before Christmas but again I'm not particularly hopeful for a positive outcome even though i juts need 2 points to get me the standard rate of the daily living component of PIP.

Average is about 5 weeks, they can be a little less and a lot longer.

An update on my mandatory reconsideration letter I sent to the DWP on 7 November,: I got awarded PIP! And not only PIP but also the enhanced Daily Living Component. Considering I was looking to only get two more points to get the standard rate, to get the enhanced rate is both a shock and most welcome. I was after two extra points, the DWP gave me six.

Had it not been for the helpful guides here at B&W I doubt I would have got anything, so a massive thanks to B&W and to the mods too. The help has been much appreciated.
