Hi Bud
Yes I got some of what I requested, I asked for esa85A, LT54, esa55, esa72, I asked for the score sheets to find where they had awarded me points, any further notes, emails etc.

I got a copy of esa85A, Lt54 X2 for some strange reason, esa55 history of IB/ESA 65 page report on plain paper, copy of my esa50.

No copy of esa72, no points score sheet, no other info, maybe there were no score sheets or esa72 raised but again we have to believe that dont we ;)

So a basic amount of info considered what I had asked for.

Will be back on forum tomorrow.

Regards, Derek

HI Mods
What happens if you want all the info that you asked for and they dont give it.
And is there a fee to pay for SAR from DWP

Hi B,

It is best to request an ESA85 if you had a face to face, or an ESA85A if you didn't, there will definitely be one of these.

There will also definitely be an LT54.

With regards to other ESA Documentation, there may or may not be an ESA113, or an ESA72, so just because you may not receive one of these does not mean that they are withholding them, it may simply mean that they don't exist.

So, to cover all bases, you could request the ESA85 or ESA85A by name, and the LT54, you could then request any other documentation that was used in coming to the ESA WCA decision, citing the Decision Notice letter that you received, (date etc), you could even incude a copy of The Decision Notice letter.

Issuing a SAR to The DWP is free of charge, as you will read on the second and third links below :

Hi B,

The DWP have 40 calendar days from when they receive the SAR.

You could send them a reminder, with the threat of a complaint to The ICO, or if you feel that they have failed to comply, you could complain directly to ICO.

Or, you could give them another week or so, it is up to you.
