Whether to claim JSA or not is entirely down to the individual person, you cannot be made to claim any benefit, nor am I aware of any requirement for you to declare them free to work.

Sorry I meant to get housing benefit you have to be in receipt of benefits and my Carer doesn't work because he is a full time Carer for me but until my PIP is resolved their benefits are stopped too.
When you sign on for JSA they make you sign a declaration that you are actively seeking and available for work, which my Carer would not be able to do.

Hello can your Carer have their income support backdated 3 months like their Carer's Allowance?
And yes I have been awarded PIP the letter came on Christmas Eve.

Was this on the new or the old claim?
If the latter and your carer can show that they have been providing care since the claim was stopped then they may be able to backdate to the date that the PIP was originally stopped for both the CA and the IS, they need to make the claim within one month of the Decision date.
If the former then it will depend on the Effective Date of the Decision, I don't believe that they will be able to backdate before this

Thank you Gordon.
My PIP has been awarded exactly from where my DLA had been stopped so basically PIP has now run on from that so one would assume my Carer's benefits would be the same, yet income support says it is never back dated but it is the main part of my Carer's benefit!
