Hi

My brother has uncontrolled epilepsy he underwent his second brain operation in the hope this would alleviate the problem at the end of 2016. He got called for an assessment of his condition by the DWP in 2017, as he can walk unaided to the shops about couple hundred years away his mobility component was removed from his DLA payment. He did appeal this decision however he got turned down. As time has passed his seizures are getting far more frequent and as he lives alone I am worried about him (this is another query) should I try to get his mobility conponent reinstated. He has actually attended a memory clinic for problems assossiated with his memory where health professionals have also witnessed the seizures. Sadly he does not know when he has had seizures.

He can report a Change of Circumstances, however

- if he was under 65 on 8 April 2013 (UK Mainland) the it will result in an invitation to claim PIP, although this may help with a Mobility award, it may impact negatively on his Care award, so you/he should think very carefully before doing this and review our PIP Claim guide for information on the PIP criteria.

- If he was over the age of 65 in 2013, then he retains his DLA however he cannot be awarded Mobility if does not have a current award, so there is not point reporting a change unless he hopes to increase his Care award.

This is a minefield. I have checked his payments again, he is, in fact, receiving ESA and PIP, the loss of mobility payment has meant a loss of £82.80 a month. I feel it is very unfair as he has undergone brain surgery twice, his head is covered in scars from falls, he lost 80% vision in one eye plus his front teeth and he still has seizures. These people are truly heartless, it makes me despair of the human race.

If he is already on PIP can you explain what you mean when you said that he had already appealed the Decision?

Did he request a Mandatory Reconsideration or did he request an MNR and then an appeal.

If the former only then he still has the option of going to appeal if the Decision was made less than 13 months ago. However, I'm unsure from your post whether he meets the criteria for a Mobility award! Have a look at our PIP Claim guide for how he needs to be limited.
