How do I make a complaint about the DWP was created by marieukxx
The more I sit here and think about it the more angry I am getting. In my fathers case the new safety ruling and the fact that the 50% rule does not apply then was not taken into consideration. They say it was but if it was he would have scored points for 2 of the activities he scored none for. Their reason for not scoring him is because it doesn't happen often enough!!!!

So now we have to go through the whole process of appealing and going to tribunal to get the 2 extra points he needs!!!! This just isn't right. Is theer any way I can complain about this case manager not using this new ruling? I've tried ringing and I've spoken to two case managers who seem to know nothing and just read back to be what the HCP said in her report. They also told me it went back to the HCP and she's the one who advises them. Is that even true? I always thought it was out of the assessors hands after her report. But they insist it goes back to the HCP.

Also where does how can they get away with not using medical evidence provided? I provided a new GP's letter which it says they did use but there is no mention at all of his audiologists letter!!!!!!! How can they do that?

An MR and Appeal is the only way to challenge what the DM has done.

Be aware, the revision of the safety rule doesn't provide automatic qualification, you still need to explain the risk and its likelihood, the panel must also consider the severity of any harm that might occur.

Also think about the ways that the risk can be reduced without the need for supervision, as a simple example; someone with narcolepsy could avoid falling when Preparing Food by sitting on a suitable stool or chair, you will need to argue against these provisions.
