Dear Gordon,
I am incensed to read that on several occasions recently the Capita assessor has maliciously alleged that the claimant has not been at home for the appointment, so DWP has cancelled the claim.
When the claimant has refuted this, even providing evidence & witnesses, the assessor has said they waited 15 minutes & provided a description of the front door. This is available on Google Street View!
I think that this is an offence under the Fraud Act 2006 Section 2 a& b : it is an offence to make a false representation & to intend to cause loss to another or to expose another to the risk of loss. (Loosing the car, even if reinststated later etc).
Obviously claimants need to phone Capita at the time of the appointment on the landline/
Iphone with locator to verify that they are at home! (Record the phone call & ask clerk's name).
It is not reasonable to allege that someone ill enough to need a home assessment will not be at home at the time of the appointment.
Do you know if legal aid is available in these circumstances? I would certainly contact CAB for reinforcements.

I expect I'm getting obsessed about not being able to defend oneself about assessor's lies (in this case assessor lying about people being out at time of home assessment!).
However there is an article in today's Independent about Michelle Moloney from Nottinghamshire having her claim cancelled because the Capita assessor lied & said she was not at home at the time of her home assessment. She complained but the assessor gave a description of the front of her house (from Street View??) . I imagine the assessors are lying to save the time & effort of doing a home assessment.
DWP would only reinstate the claim once the Press were involved. The excuse given was the assessor was too early!
So important that people can prove they were at home (ie landline phone records).
I am ashamed to live in this country. God help us!

I’ll confirm that the changed capita statement to “assessor was too early”was also a lie. I hadn’t set foot outside the front door that morning, that’s a normal occurance for me five days a week. My friend had come over an hour before the appointment time, and no one knocked on my door, they sent my file back to dwp as did not attend, and both capita and dwp told me to clear off and say goodbye to Dla and sdp on esa. They then messed up and stopped both Dla and esa completely instead of just removing sdp from esa. So I found the nice may bul,an and she did some research and made some calls and I now have a third appointment I’m hoping they will actually attend! Though I strongly suspect they will use my having gotten a national paper involved against me in every way they can.

Hello catlover,
I doubt that Capita/DWP will even see you as a human being, its nothing personal- to achieve their agenda they have divorced any morality or humanity. We are just numbers.
I doubt the assessor will even know the fight you have had to reinstate an appointment.
But we do and you are not alone!
If its not too late request that you can record the assessment (2 tape recorders & tapes available Argos or Amazon, test distances first). If not covert recording transcripts have been accepted at tribunal.
Confirm that you are at home at the time, phone records, photos with time, credible witnesses.
Prepare for the questions using B&W, see David's comments about answering "No, but" rather than "Yes, but". Don't understate day to day difficulties, which you are used to coping with. Assume assessor knows (and cares) nothing about your disability.
Keep up the good fight!
