Hi my dla to pip was turned down after mandatory reconsideration i was awarded 0 points I am waiting on a tribunal date and received a copy of my files from the dwp in a section on the file it advices the panel on what award should be given if they think my dla to pip decision was wrong it's says indefinite with 10 year review was wondering if this is put in all files .Also I downloaded a copy of the doctors form from your website for my neurologist secretary who is asking my neurologist to complete incase I have not had my follow up appointment before my tribunal my appointment is in a back log and they dont know how long I will have to wait to be seen aswell as the form i enclosed a letter telling my neurologist of the changing that have happened since my last appointment .Has anyone any idea on the waiting time for tribunals in northern Ireland.Any other advice would be appreciated.Also what is the 50% rule my condition has got worse due to the stress of this changing from dla to pip

Have the DWP contacted you since the MR with an offer of an award? If they have then this letter is in regard to that, if they haven;t then you should contact the DWP about the letter to find out why it has been included.

I'm afraid we don't have a view of waiting times for appeals in Northern Ireland, although I am aware that appeal rates in NI are higher than the mainland so this is likely to mean an increased wait.

PIP requires claimants to have their limitations on the majority of days (50+%), this is different from DLA which was more than 50% of the time.

Your appeal can only take into account your conditions as they were at the time of the Decision being appeal, so I'm afraid there is a good chance that your Neuroligist letter will be excluded. Can you provide any new evidence that relates back to that time?
