Dear Benefits and Work,

Today my dad received a letter from the DWP, along with 2 forms, one small, one large. The letter states that between November 2012 and July 2016 my dad was paid contribution-based ESA which replaced the Incapacity Benefit he was getting. And that he MAY be due further extra payments?

From what I've just read on the B&W site it's a legitimate form?

However, my dad is stressing (a lot), his anxiety is returning tenfold just from further contact from the DWP :( He is suspicious straight away - thinks the DWP are looking to get some form of back pay or stop his current PIP. Paranoia I know - but his illness causes him a lot of worry and anxiety... so much so that he doesn't want to return ANY of the forms.

I don't think he has anything to worry about. He initially claimed Incapacity Benefit, which later became ESA (until he stopped claiming on retirement), and DLA until it changed to PIP (which is now the only benefit he claims). To my knowledge, none of these benefits were means tested, so he should be fine. Please correct me if I'm wrong - I'm just looking to reassure him.

Long story short, he's been through so much with the DWP, incorrect decisions made, courts reversing DWP mistakes, that he just wants to not complete the forms at all. Either of them. Would this be detrimental? Do they have to be completed?

Are you able to confirm whether the following benefits are means tested, please?

Incapacity Benefit, ESA, DLA, and PIP.

Also, within the link you supplied it advised that if you are certain that throughout the period in question you were not eligible for ESA(IR) then you can return the form uncompleted, that the DWP for there own records would want a reason for this. If you tick one of the boxes that they supply would it have a negative reaction on the above benefits for any reason? Also, if you add your own explanation would this just be on a piece of paper attached to the form?

Incapacity Benefit was a Contribution Based benefit, it is not categorised as means-tested but pension income could reduce the payments.

DLA and PIP are not income benefits, they are not means-tested and are not counted as income for means-tested benefits.

ESA has both Contribution and Income Related (means-tested) components.

Not completing the form will not have any effect on your benefits.

Yes, just write a short letter.
