What should I include in a PIP manrecon request? was created by janeyj
Hi, I lost my PIP and will ask for mandatory reconsideration. How much information should I include in my reasons for disagreeing with the decision? Specifically, should I quote relevant case law and reference the cases, or save that for if it needs to go to tribunal?
Using PIPinfo (linked from the Benefits & Work Guide) I have researched a fair amount of the relevant case law for the descriptors I feel I should have gotten points for. But now I'm trying to trim an application which is just as long as my original PIP application was, I wonder if including case law at this stage might actually be detrimental to my claim.

Assessors and Decision Makers will only operate within the guidance that they have received from the DWP, so whilst they must take account of binding Upper Tier Decision they are not going to do so unless instructed to do so.
Bottom line, it's worth mentioning the Decisions but don't expect too much from them at this stage.

Commiserations in losing your application for PIP. I’ve been through all this with a family member I care for. For our manrecon request I wrote a fairly lengthy letter detailing where the assessor had made errors and wrong assumptions in the assessment, with reference to specific descriptors. My letter was ignored at that stage but proved vital as evidence for the tribunal panel. They even commended how clearly I had addressed each point, which helped their decision to overturn the DWP’s initial decision not to award any PIP points. I think it would be a good idea to provide details in your letter of how the descriptors apply to you personally rather than bring in current case law. The DWP may well ignore your letter but it may have vital information for an appeal panel. Good luck!
