Hello Gordon
I have recived a letter from HM-Courts and Tribunal service to day the 30/01/19
I was told by the Statement of reasons for decision my pip was heard on the 20/12/18 but was not awarded for my pip- in the letter thay sent me to day what to next is to take it to upper tribunal
there for I can not go to this as suffer from deep anxiety and depression issues but thay did not take this into the account of my pip. so need some help on this do I need to take it to upper tribunal or re do an orther pip forms ??

AS you did not receive an award then I would write to the Tribunal Service asking for a Statement of Reasons and the Record of Proceedings from your hearing.

This is the first stage to requesting an appeal at the UTT, your request needs to be made within one month of the date of the letter you have just received.

Doing this does not commit you to making a further appeal but it will allow you to understand how the Decision was made. You need to understand this if you are to make a new claim for PIP or you risk being turned down again.

An appeal to the UTT can only be done if you can show that there was an Error of Law in the making of the appeal Decision, not because you disagree with the result.

What is an Error of Law?

You can make a new claim for PIP at any time, there is no waiting period.
