WHAT HAPPENS NEXT? (PIP) was created by CATHYCOMEHOME
I have asked for Mandatory reconsideration PIP in a letter.
I also asked in the same letter for a detailed explanation of how the DM came to his decision of awarding 'zero' points.
How can I argue against the DWP decision if I have not received details of DWP reasons?
What happens next? Do PIP send me a PIP Mandatory Consideration form to fill in?

The Decision Letter has the DM's Statement of Reasons for the Decision, so don't expect any more information other than the assessment report.

You can request the MR by letter, there is an example in the MR & Appeals Submission PDF in the PIP area.

You should be able to make a start to your request from the information in the Decision Letter and provide a more detailed response when you receive the report.

Your primary aim is to make sure that you have shown that your son meets the criteria for an award, I would go back through his PIP2, our PIP Claim guide and the Letter/report. Make sure you understand the Descriptors and don't be tempted to try an bring them to your son's conditions, it won't work, check that you have met all of the elements in a Descriptor they often have multiple requirements and you need to meet all to score and lastly, have you made appropriate use of the "reliability" criteria?

I have done exactly that - I have worked so hard at trying to prove my son meets the criteria. I am in the midst of writing mandatory reconsideration letter (is a plain letter alright) or do I have to put it all on an official DWP PDF download. I prefer to put it on a plain letter.

I have not received the assessors report yet & I am trying to make sense of the decision makers vague comments of what they are implying.

A one off title 'You do not have a physical disability' . I have applied because he has a Severe and enduring disability - what am I supposed to read into that? Do I have to my argument against these reasons? As well as focusing on the descriptors (which I am working hard on)

I cannot understand why are they vague like that? instead of giving a clear indication of why my they believe my in their opinion did not meet the descriptor?

I am near to tears with frustration because I know my son rightfully is entitled. I am focusing on the descriptors . He uses a microwave - not a fact that he cant be bothered cooking from fresh food - he lack the motivation & is not safe poor concentration span - he got zero for only being able using the microwave???

You don't mention what condition(s) you son has so it's not really possible for me to comment on what the DM has said in their Decision Letter but if he does have a physical disability and it impacts on his ability then you should highlight this in your letter, it is the sort of fundamental error that can get the Decision revised.

Re the Preparing Food, this is a case where you not only have to show he meets the higher Descriptors but also that he does not meet any of the lower ones, your post suggests that he could cook on the hob if he received suitable prompting to do so.

Hello Gordon,
he suffers from Paranoid Schizophrenia - his condition is chronic long term condition
Not really trusted to use the hob as would leave pans on - once pulled poultry out the freezer straight into oven & pulled it out half cooked hot outside cold in the middle - lacks motivation, eats 2 microwave meals in one sitting & gets takeaways to satisfy hunger
Antipschotic medication - has drowsy effects - sleeps in clothes has to be coaxed to have a shower - in and out of bed all day - sometimes until 4 pm or later
gets upset - agoraphobia - panic attack - paranoia - always leaves part drink at home thinks spiked
He really suffers but you cannot physically see what is wrong with him. Letter states managed well at assessment - cannot see his illness but he was nervous - he would not have even got there if it were not for family taking him

So the comment "'You do not have a physical disability" is just a statement of fact and is not something that you need to deal with as it won't lead to points.
