Hi Gordon.
I am in the Esa Support Group also claim for my partner who is 77 and disabled as well. He is in receipt of Both Higher rate of DLA.

I claim CA for him but don't receive the money just the underlying benefit for him.

He has never been invited to apply for his old age pension by letter or telephone call and we didn't think anything of it other than just he wasn't entitled to it as he hadn't paid his full national insurance stamps due to being self employed before he took poorly.

Hearing about the new rule thats coming in for mixed aged couples we wondered if we might be better off applying for Pension Credit now, as I am only 62 and have a way to go before I reach pensionable age. If we do decide to go ahead will I still be able to have my National Insurance stamps paid if I stop claiming ESA in my own right ... Oh it's such minefield ... we really don't know which way to turn. I'm also worried now we might get into trouble for not applying for his pension even though we didn't know he should have.

I didn't know that I could claim PIP in my own right until recently as I thought it could only be one person claiming it in one household. Is so difficult when you have no one to ask.

Any advice would be appreciated. As we live quite rural we don't have a welfare rights office close by to go to.

Try putting your information into one of the online benefit calculators but I would expect you to be better off under Pension Credit than you are at the moment.

As your ESA appears to be Contribution Based you can continue to receive while your partner claims PC it will be treated as income and deducted from the PC, however, the CA that you are also claiming also includes NI Credits that count towards a full State Pension so you don't need to continue to claim ESA for this purpose.

I would get your partner to contact the DWP about their pension.

You need to make a Decision before 15 May.

Thank you for your swift reply Gordon.

So just to clarify if he claims his State Pension topped up with PC does that mean I will still be able to claim CA for him which will then mean I will still have my NI.Credits paid for me till I reach pensionable age and I can cancel the ESA claim. Sorry if this seems to be repeating myself Its just I want to be totally sure before we go ahead ...

I do really appreciate your help in this .. as I'm sure lots of us do .. not sure where we could turn if it wasn't for this site

Yes, if you cancel your ESA claim then the CA will become payable and includes NI Credits for your State Pension.
