PIP Decision was created by MistyBlue
Dear All,

I received my decision letter which entitled me to highest care and mobility, which I am
so pleased about, however as I was previously in receipt of DLA indefinitely, they have
given me a 3 year term .... which just misses out on the "soft review" if they come into
affect as scehduled.

During the whole of the ordeal, I suffered 2 further strokes in January, they were aware
of this, I haven't received my report as yet, would you advice, or am I able to ask for
a reconsider of length of time only? Or am I better to leave things as they are?

There were several answers where I received 0 points but it's not relevant as I received
enough to qualify.

Kind regards, and many thanks to all of you .... we would all be lost without B&W!

The award length is part of the Decision so it can be challenged by an MR but you need to be prepared to go onto appeal.

Award lengths are supposed to be reflective of the claimant's limitations changing, this could be getting better or worse.

If your strokes had an effect on your limitations in completing the PIP activities then this cannot be considered until you have suffered those limitations for three months and there must be a reasonable expectation that you will suffer them for a further nine months.

Thank you Gordon, I should have also mentioned, I also have;
Systemic Lupus
Fibromyalgia
Anti-phospholipid syndrome
4 x strokes
Many TIA's (Mini strokes)

As 2 of these are autoimmune illnesses, I will not recover from these, and the previous
2 strokes took place in 2013 and 2017, then I believe the stress of the PIP application
and trying desperately to fill out forms and comprehend what it is they are asking (another
0 points regarding complex information)
In the long run, I am not going to get any better .... if anything, I am at high risk of further strokes
as my INR levels are not in therputic range, I am tested weekly for warfarin levels, this is
due to the APS. (Apologies for getting too medical here!)

Given this information, would you ask for a mandatory reconsideration only for the
length of time?

Kind regards

Misty.

I'm really sorry but I cannot answer this.

You say that your conditions are not going to get any better, how likely are they to get worse and is this likely to happen over the next two to three years?

Will the deterioration increase the number of points that you might score? Getting worse does not always correspond to your scoring higher.

Many thanks ...... I think it's just my concern of having to go through it all again.
However Ive just seen the News mentioning over 65's wont be reassessed, hopefully
its a step towards all of us joining this change.

Im grateful for what I have, and so pleased I dont have to go through the whole appeal
process like so many.

Good luck to you all.

Thank you Gordon.
