How does this affect NI contributions? was created by JeBa
Three concerns any responses to the following welcome:
1. My ESA claim started in 2010. In 2016 my claim was stopped in error by the DWP with the DWP falsely claiming no receipt of the form sent by special delivery and signed for by their agents. It took several months to eventually be, what I thought was, reinstated back to the support group but it appears they actually started my claim a fresh from 2016.
Hence I've received an ESA50/ 05/18 CfW Questionnaire, I read the ESA50 form I should receive should end 11/2013 as my original claim started prior to Jan 2013.
Is this a reason for a written complaint or legal intervention. Does this claim restarting in 2016 affect NI in the long run?
2. Does the DWP intentionally hold you on phone calls for ridiculous durations alleging they are inputting data in multiple systems as a devious tactic? I've never experienced this before. I contacted them about getting reasonable adjustments (as stated on the Questionnaire) and they tried to fob me off to the medical contractor, caused me significant physical discomfort/pain as a result of their conduct. I argued they were wrong and they eventually conceded.
3. Another concern, worryingly, Mail workers having access to all your personal subject data without your consent by opening mail for redirection on behalf of the DWP which includes proof of income, NR numbers, account numbers, D.O.B, everything they need to enact fraud, etc.
Hope someone can shed light on this.

1. This new ESA50 is nothing to do with what happened in 2016, nearly all ESA claims are reassessed regularly, the longest period for members of the Support Group is three years.
2. No. If you were asking for accommodations with the assessment process then this is the responsibility of Maximus, the Assessment Provider and not the DWP.
3. They are bound by the same levels of confidentiality as any other person involved in your reassessment. No one on B&W has reported a breach of their date by the Royal Mail staff.

Hi Gordon,
1. Confused, so are the Guides out of date as they state there being ESA50 01/13 and ESA50 05/18 forms one for claims before Jan 13 the other after.
2. It was the capability for work form I wanted in large print or audio as it states on the front of the form, with the contact number, to contact them direct if you need one of those accommodations. That's why I called it as it directs you to.
3. I wish everyone was honest but that's not been my experience. Are RM considered data controllers? I don't think so. I've read numerous articles about some RM employees acting dishonestly and you'd never be able to trace it directly to that source.
