inordinate delay for tribunal was created by Helen Chapman
We are going to have to wait well over 18 months for a tribunal. Will the award decision be made based on condition at the time of original application or at the time of tribunal?

The Tribunal re-makes the Decision being appealed so any back payment will be from the date that the original Decision was made and not the date of the hearing.

Hi Gordon
Thank you for your reply, however i was asking about condition, not money. For example you can walk distance x at the time of assessment and MR but can walk distance Y now which is less than distance x

Forgive me, we normally get asked about payments.
The panel can only consider the claimant's conditions as they were at the time of the Decision any changes since then are legally excluded.
