Has anyone benefited from the governments new guidelines on PIP soft touch, thet say they are going through claims in date order, approaching review to see if the duration can be changed?

So far one member has reported their original award being revised to an On-Going one.

Hello Gordon

I have just read the ATOS report for my son, it was paperbased, they called the CPN and GP who both gave a good account of my sons mental health and confirmed unlikely to change. With regard to the new soft touch guidelines what is the point when it is ATOS guiding the decision makers with durations, should ATOS not also be following these guidelines? ATOS recommended 2 years and devision maker gave 3 with a 2 year review. I am afraid to challange this as the award is enhanced and enhanced.

One thing you could do is make a complaint to ATOS about the report specifically in the context of the recommended award length, if they revise the report with a longer date then this may give you the confidence to ask for an MR.

Hello Gordon

As it was paperbased at my request, I am afraid to rock the boat and be asked for another asssessment, or given a lesser award. I am shocked at their brutallity and my son could not have coped in any way with a f2f, I wrote a lengthy report with your guidelines, which they ignored completely apart from the last question about walking distance and I said about pacing, although I also said I was not sure that this would count but wanted to mention it, that is the only reference they made to everything that I submitted. They called the GP and CPN and appear to have gone through every descriptor with them, they have given good evidence and have been marked lowly 19 points for care and 12 points for enhanced. On the form it says is ther anything that would stop the claimant from complying with future claims procedure, which there is, he cannot cope with f2f and ATOS have answered no. I did find the report distressing with the CPNs comments, true but distressing to read. Do you think that it is reasonable to leave things as they are and address duration at review.

It doesn't matter what I think, only you can make this decision just make sure that you are comfortable with it.
