PIP assessment problems - any help appreciated.

Thanks for reading this. The PIP application process has been very overwhelming for me so far, but I'll try to explain my problem the best I can. I suffer from epilepsy, depression and anxiety, all for about 20 years. I sent off my PIP application form at the start of January and after a few weeks received a letter saying I had a face to face assessment at the beginning of February. I went to this, managed to get a friend to drive me there as it was a long way from where I live and arrived in the waiting room approx 30 mins early. When my time came I went into another small room with the person who was assessing me, just me and him. He told me we were starting the assessment and asked me many questions about my conditions for approx 30 mins. He left the room twice, the first time for a few minutes and again for approx 10 mins, while I waited alone in the room. When he returned, he said he was stopping the assessment and wanted me to send in more information about my conditions (I have already supplied lots) and that he had typed up everything I had told him so far. He gave me a freepost envelope to send the further evidence back in and off I went. I was very confused, but just did as he said. Soon after, I sent back copies of the medication I am on and a note from my Doctor, all in the freepost envelope. About a week later, I sent them another letter asking if they had received this and what stage my application was at. I heard nothing back. About a week ago I received a letter from the DWP which says 'We've decided you're not entitled to PIP. This is because you didn't go to the assessment on...and we don't think you've given us a good reason for this'. I am shocked that they would either make a mistake like this, or lie. I spent weeks filling in the form and preparing for my interview and I wouldn't dream of missing an appointment like this. I really don't know how to proceed. What do I do next?

Did you receive an invitation to a second Assessment?

The DWP letter implies that they wrote to you for your reasons for not attending an assessment, did this happen.

Was this a new application for PIP or are you currently receiving DLA and being "transferred" to PIP?

Hi Gordon,

Thanks for your reply. I have not received an invitation to a second assessment. Also, they did not write to me to ask my reasons for not attending. This is the only letter I have received from them since I went to the face to face assessment. I'd be happy to show you the letter if you like.

Yes, it is a completely new application for PIP, I am not receiving DLA or being transferred. An epilepsy specialist advised me I may be eligible for PIP, so I applied.

I really appreciate your help,

Rob

You have two options;

- You can cut your losses and make a new claim for PIP, there is no waiting time.
- You can request a Mandatory Reconsideration of the Decision based on your attending the first appointment and your not having received a second appointment.

If you go for the MR then write a letter to the DWP office that was dealing with your claim, head it with "Mandatory Reconsideration Request" and explain what has happened.

I would also contact the Assessment Provider and ask them for a copy of the appointment letter for the second appointment letter. Ask when it was actually scheduled for.

Hi Gordon,

Thank you, what you have said is helpful to me. I have not heard a thing from them about a second appointment. All I know is I went to my face to face assessment, then received the letter I have told you about. Are they meant to offer a second appointment?

As no report was produced from the first assessment then a second one should have been booked.
