Hello, I’m a fairly recent member so it may be this question has been asked before. I’m recently divorced and my ex wife is wrangling over a financial resolution and has taken it to court. We have just reached the point of starting to negotiate a settlement. My solicitor has include my ESA and PIP as income. However I understood that PIP could not be counted as income as it is solely for me to cover the extra costs caused by my disability and remain Independant. Is this the case? My health has deteriorated rapidly hence my now recieving the lower rate of PIP. I’m also concerned as these benefits can cease in a pretty arbitrary way which would leave me broke. I need to update PIP about my deterioration but am concerned it’ll just get knocked of any spousal maintenance I might get. It’s a total nightmare and I think she’s hoping to just wear me down.
This is a Civil matter so I am afraid there are no rules about how your PIP income should be treated. All I can suggest is that you speak to your solicitor about your concerns.
