Both my wife and i are disabled. I am in receipt of DLA and my wife PIP. I claim for my wife and receive EESA and i am in the support group, I also claim Carers Allowance for looking after my wife I had numerous letters recently saying my wife could be called up for a work capability assesment then 4 weeks ago we got a work capability assessment form through the door in my wifes name. We automatically assumed this was for my wife and filled it in accordingly accompanied with medical evidence. Today my wife received a letter saying she was my appointee and that an appointment had been made for me to attend for a work capability assessment. I phoned them up and got spoken to like a piece of dirt. I explained that we had filled in the form assuming it was for my wife and had sent it in recorded delivery. I ask how it would work because they would have no information about me and got told it didnt matter because they had information from my GP. My question is can they enforce this appointment without having a form filled in by me about me and how can i be available for work when i care for my wife more than 35 hours every week. This is really stressing me out so any help appreciated. I reside in Scotland just in case it is relevant. Thanks

There is no legal requirement for an ESA50 to be issued as part of the ESA assessment process, so a face to face without one is permissible.
You can either complete a new ESA50, one can be downloaded from the following
www.gov.uk/government/publications/capab...r-work-questionnaire
Or, you could write a letter in a similar format.
In either case, if time allows then post it to the assessment centre where your appointment is. Take a copy to the interview and ask the assessor to read it and include it in your file before they return your file to the DWP and I would send a copy to the DWP office dealing with your claim with a covering letter explaining what has happened.
The assessment is about whether you are Fit for Work not whether you are available for work.
