Appeal was created by Nanadi10
Hi,
I have received a letter today as I had asked for decision to be reconsidered and to be placed back in support group as they had placed me in wrag after medical assessment, I am going to appeal and will use the forms shown on this site, I understand appeal dates can take along time to come in the meantime will I still receive payment all be it lower till appeal date arrives? and will I still be made to attend wrag meetings to.
Lastly now I have received the letter to say they won’t change decision how long do I have before submitting appeal, also how long is waiting time for appeal date to come.

Thanks in advance
Much appreciate any help as this has me stressed to bits.

Regards
Diane

Yes, you will continue to receive the WRAG payments while you appeal but I'm afraid your appealing does not exempt you from being required to attend Work Focussed Interviews and participating in Work Related Activity.

You have one month of the date on the MR Decision to request an appeal but you can make a Late appeal up to 13 from the date of the letter,

The ESA Appeal guide has links to the SSCS1 form that you will need to complete and the Submissions guide has a complete example that you can use to help you fill it in, you do not need to provide detailed reasons at this stage for your request.

Once your appeal is accepted the DWP will prepare their submission to the hearing and send you a copy, whilst you should wait until you receive this to finish and submit your own, you should start to prepare your own case, an increased award will only be made by your showing that you score the extra points for one, so I would start by going back through your ESA50, the assessment report and the ESA Claim guides to see how you might show this is the case.
