Hi
We have received a copy of the Assessment Report made by the HP on my wife. We appreciate this is not the DWP decision.
In some respects its good as it looks like they are recommending:
the Enhanced Rate of mobility (12 points - agreed)
the Standard Rate of daily living (11 points - should be higher in my opinion and I think we could evidence this)
However they are only recommending 2 years award.
Could you confirm if this period of award means she will loose out on a new mobility car? She has 4 months left on the current lease period.
Also they have based this on "She has a degenerative condition associated with her breathlessness, she is on medication for her breathing. It is medically reasonable to suggest her level of functional ability will deteriorate in the medium term. Although her mental health is not causing her any functional restrictions at present, she is prescribed medication for her mental health. Due to the nature of mental health conditions a fluctuation in her level of functional ability is likely in the medium term. Therefore a review period of 2 years is medically advised".
This isn't making any sense to me. From what I can see she has not been awarded any points due to her mental health, however they are looking to review in two years because her MH may fluctuate. They have acknowledged her breathing will degenerate. They have not mentioned that her spine and hips will degenerate. Make any sense to you?
Also the report is full of inaccuracies (one works in her favour), some which contradict a recent orthopaedics report. Is now the right time to write and correct these, or should we wait for the DWP decision?

There is a window for you to write to the Decision Maker before you get your decision letter, but you will need to be quick.Understand that the assessor is offering an opinion if they say that your wife can do the PIP activities, tackling these head-on is unlikely to be successful, you need to show that the basis of that opinion is founded on incorrect information, so try and refer to your evidence to undermine what they have said.Also, try and stick to issues that lead to your scoring points, I often hear members referring to the assessors spelling, as an example, whilst it may show a lack of professionalism, raising it as an issue isn't going to help you get an award.Lastly, make sure that you understand the criteria that you are being assessed against you can put the best case forward that is possible but you won't score points if you do not meet the PIP Descriptors. And although it might be tempting never say that the assessor is a liar.
You could in your letter ask for a long time. It is hard to think that two years is 'medium-term', especially as they will review 6 months before the end of the award.

Paul,
Regarding the Motability car, if 12 points for mobility is awarded and so enhanced rate then you would still be entitled to the Motability scheme. Also, although the lease term for Motability is 3 years you only need to have 12 months worth of PIP remaining to apply for a car.

Thank you both, that's very helpful.
In the difficult position of whether to accept the inaccuracies or risk rocking the boat.
Am I correct in that the review is a simpler questionnaire that asks if your condition has changed or not? A F2F is unlikely?
In which case could run with the initial decision and then when reviewed ask that the period is extended as they will then have the history of the permanency of her conditions (I'll make sure we can evidence)....or just keep reviewing as her condition will not improve....

A review does not mean that a f2f is unlikely. A lot of claimants are reassessed especially when they are on short awards. There is very little risk in contacting the Decision Maker - there is more so if you decide to put in a mandatory reconsideration after a decision has been made.

Thank you.
Followed your advice and contacted the decision maker in the small window of opportunity before we received the decision letter.
Received the PIP award last Friday and looks very good:
Enhanced rate for daily living needs (12 points) for an ongoing period
Enhanced rate for mobility needs (12 points) for an ongoing period
Much better than the HP's recommendation in the assessment report (see below).
So a massive thank you for all your help and patience.
One final question (I promise): How long is "an ongoing period"?
