Surgery refusing to provide letter of support

Hi Team
I am in the process of completing ESA 50 Questionnaire on behalf of my husband & have been waiting for over a week for a letter of support from his GP Re: DVT, COPD, etc.
Upon chasing up the letter today, I am shocked to learn that the GP is refusing to do the letter due to some new regulations regarding non nhs matters ?
Would you be able to provide any clarification on these new regulations ?
I am challenging the surgery as I think it it totally unfair, especially as the ESA50 forms give opportunity for any supporting evidence to be included.
We have offered to pay the normal fee.
Would there be any advice on how best to approach the surgery on this matter.(as I have to ring them back tomorrow).

Hi JJ

I am not aware of any new regulations regarding non NHS matters, it could just be a cop out.
You can ask your surgery for a Subject Access Request (SAR). Up until last year the request used to cost you £10 but when GDPR came in last year there is now No cost. You do have to put the request in writing and it can take up to one month to get a reply. see ICO web site for more details ico.org.uk/your-data-matters/your-right-of-access/
You may want to add a note on to your ESA50 form stating what your GP told you and that you will send any support docs as and when you receive any.
The main thing is to get your form in on time
