Not strictly a benefits advice topic. But any advice appreciated. Having given my welfare benefits advisor my consent to complete my ESA mandatory reconsideration, I then withdrew it over a disagreement. He informed me that as he had nearly completed it he was going to complete and send it anyway, not respecting my decision to withdraw my consent. A dispute that followed with him resulted in a deterioration of my mental health and well being, resulting in my absence from a Recovery College I was attending due to severe depression. Can I sue him? Is giving / withdrawing consent a legal contract? I feel so angry with him for him causing a relapse in my mental health.

Hi Toonbadger

I'm afraid you would need to take legal advice about this and consider the costs both financial and emotional to yourself.

You could make a formal complaint to whatever organisation the advisor works for.
