Hi, I just wanted to ask a question for my friend if that's ok? She is currently on legacy benefits, and is claiming the severe disability payment. She has her son 3 days a week and he has just been awarded with DLA. Would she be able to claim carers allowance for looking after her son, even though she shares custody and his permanent address is with his dad. If so would that be taken as a change to her circumstances and would she then be pushed on to the dreaded universal credit. Any advise would be greatly appreciated,

Claiming CA is not a trigger for UC so they don't have to worry about that.

To claim CA they must be able to provide a minimum of 35 hours of care a week, you don't mention how disabled the child is but doing this in the three days she has them may be a struggle.

Thanks for your reply, that's good claiming carers would not be a trigger for UC, yes she has her son at least the 3 days, however she also has him an extra night in some weeks, and several full weeks in school holidays as his dad works. I think her son is on middle rate carers, low rate mobility and he is on the autistic spectrum. Would she be able to claim the carers and explain that the care she provides can go over the three days and can be substantially more during school holidays? Thanks

A Middle rate care award means that her son has been assessed as having care needs during the day or the night but not both so this may further limit the time that she can provide the 35 hours for.

It is sometimes possible to get CA with a varying period of caring but it is unusual and any week that she is not able to provide the 35 hours would not be payable. She needs to be careful as she does not want to get the CA and for it to be then decided that she is not providing the required care hours as this would result in a recoverable overpayment.

All I can suggest is that she is completely open with the Carers Unit about their situation.
