Early review after winning PIP Tribunal was created by Violetrose
Hi all, not been on here for a while due to poor health but could do with some more advice from you all. Had to drag the DWP to Tribunal last time to get the award I was entitled to - the Tribunal awarded it to me until March 2020 but DWP have just sent me a review form. Can they overrule the Tribunal decision?

Hi Lee

They haven't over-ruled the tribunal. Claimants are re-assessed for their PIP up to a year before the end date. Recently this has changed to about six months before, although there has been no official announcement of this. So, it looks like yours is being reviewed six months before the end date of your award. Now unless your tribunal award specifically says you must not be reassessed before that date you probably won't get anywhere with them.

Thanks for your reply. I honestly thought I was safe until March, I thought the Tribunal decision meant I was legally entitled to that help until March and the DWP couldn't take it off me before then. Seems like they can if they choose to :-(
Next question is, how much information should I put in with the review? I have multiple complicated conditions that were very well described in the original claim documents(not that they read it, or my medical evidence), do I need to cover that again or just tell them what has changed and add info on my newly diagnosed conditions ? I don't want to swamp them and end up with no one bothering to read it but I need to make sure that they fully understand my conditions and how they affect me. Thanks.

Hi Lee

I can't tell you exactly what to put because you have to put what you believe is necessary. My view is to always act as if it is the first time someone is reading it (but that's a personal view). It's just that you cannot guarantee the reviewer will be looking back at past information. So I give some detail even if a condition has not changed and I would add any new information. No you don't want to swamp them, but you don't want to find yourself regretting you didn't give them a full picture.

Thanks, it was more really about finding out what they were expecting to do with the info and whether they would refer back through the old documentation. You've just clarified that. My biggest worry is that they will be put off reading it all due to the amount there's going to be but if I don't put the info in they will have little understanding of the conditions as some are rare/not run of the mill and all are complicated. The last assessor actually told me she hadn't read it all.......she clearly hadn't read any of it from the state of her report!!

Hi Lee

It is not easy to know how much to include, but the fact is some people have a great deal of evidence. Whatever you include make sure that it's relevant and if possible quote from your evidence in your answers eg:

I am unable to prepare a basic meal because of severe osteoarthritis in my hands and feet (see letter A from Dr.X, Consultant Rheumatologist 13/04/19) making it impossible for me to grip any types of knives, or carry things safely across the kitchen
I have been assessed by an occupational therapist (see report B from - Miss Y, senior occupational therapist 12/8/17) who notes that "adapted tools would not be useful in this case


The reason why I suggest people quote if they can is because it reminds someone reading all the time that you have the evidence to back up what you're saying. If they just have to read lots of reports at the end, they have the excuse not to tie them to the PIP criteria. Make it as easy as you can for them and minimise the chance of them being able to ignore it!
