PIP Forms not received by DWP was created by Cat
Good morning
My friend has had his DLA to PIP transition cancelled as the DWP claim the forms and supporting evidence that were sent on the 17th July were not received. They have closed the case and are arranging for his mobility car to be returned.
Is there anything she can do apart from start a new claim please ?
Thank you

If they have proof of delivery then they can request a Mandatory Reconsideration of the Decision to close their claim, if successful this will re-instate their DLA although it is unlikely that the car can be returned but that is an issue for Motability.

Thanks for the reply Gordon,
Sadly the DWP are denying it was ever received, and the sender has no proof of postage.
I did not know you can ask for a MR on decisions such as this, so thank you for that.

Normally we say to members to think very carefully about making a new claim when they are challenging a Decision but this is a case when they should and as soon as possible.

If they are able to get the Decision revised then the two claims will be merged with no detrimental effect and if it is not, then the new claim will allow any award to be backdated from the date that it was made.

In a thread yesterday, called “Post mishandling sites” on Rightsnet, Dan Manville from Mental health & welfare rights service at Wolverhampton City Council states
“PIP have informed me that they have a problem receiving correspondence at the moment; they’ve been notified of problems by Royal Mail.”
So it looks like you are not the only person in this position.:(

Then they clearly shouldn't be penalising people as a result.
