hi there

i have a face to face assessment next week... i am on ESA activity group ..due to mental health and physical due to arthritis..
i am just wondering what to do if i fail my assessment and do not score enough. from your guide i understood that all benefit will stop.
can you advice to what i can claim while i am requesting mandatory reconsideration..
i am very worried i will loose my flat .. and go into debts , how will pay council tax and rent..i am in a social housing.
i am worried to that fact i took up some permitted work to help me with my mental health ..this might effect their decision ..this work has aggravated my arthritis as it involves standing about 1:45 min.. my ankles and knees are badly swallon ..yet i carry on doing the work..
got doctor report ..to confirm this ..
i feel i have a weak case , i have followed all your guide lines in filling the form.

Hi faa_99

If you fail your assessment then the first thing you need to do is inform your local authority that your ESA will stop and that you will be appealing the decision, your HB and CTRS should then carry on, if not seek advice from your local welfare rights unit.
Whilst you are in the MR phase you will not receive any money, if your MR is successful then everything goes back to normal depending on which group they put you in.
If your MR is turned down then you need to appeal, once you put in an appeal and get notification from HMCTS that they have received your appeal then you should be able to get some ESA to live on whilst you wait for your appeal hearing. If you fail to turn up at an assessment then you won't be entitled to any ESA until you case is heard and you win the appeal.
