PIP Mandatory reconsideration. was created by annigoon
Should a neurological examination have been done at F2F pip appointment for Spinal Stenosis and Cervical Myelopathy. Also have Arthritis Asthma and CFS
H P states musko skeletal examination given( with all measurements taken with an invisible measuring aid) Then proceeds to say all activities I state need assistance or can't do, are all waived as I was seen to open fingers at examination therefore can use aids. How I do state on Mandatory Reconsideration without saying these are lies. ???
Hope I have explained this as i am totally confused by all this filling in forms and medical reports being overlooked. Thank you in anticipation of your assistance with this matter,.

Replied by BIS on topic PIP Mandatory reconsideration.
Hi abkd90
There is no neurological examination that would have been of any value at the assessment - so the answer to your first question is no.
I assume and perhaps I am wrong that you have the full medical assessment report. You can certainly say that the assessor categorically did not do a musko skeletal examination and is not being accurate when they say they did! You need to then counteract their assumption because you 'opened your fingers' this means automatically you can use aids. If you do not use aids, you need to say why not, what have you tried or been recommended and the reasons why using an aid, either will not improve your ability to grip things or are useless in the first place because of your grip. And you need to go through every question concentrating on the areas where you believe that you should have scored points and you didn't. Secondly, you need to back up what you're saying with any medical evidence you provided, doctors, consultants or OTs and quote what they have said throughout your written reply. For example
"The Assessor said that she saw me move my fingers and therefore I can use aids to prepare a simple meal. However, in the letter from DrX dated 13/02/19, it clearly states "I have been treating abkd90 for the last three years and there has been a marked deterioration in had movements, that means they have a limited ability to grip any items at all."
Obviously that's only an example and you know what evidence you already sent in. Don't waste time saying the assessor is a liar - it won't get you anywhere and you can always make a separate complaint about that if you want.
