I had a friend asking me for help with their claim from DLP to PIP that has encountered a problem. He knows I have just gone through this process recently and had to appeal to the DWP and won my appeal PIP mandatory Reconsideration level.
My friend got his PIP forms through but he needed more time, and a new deadline was given to send in the claim was now 23rd September. He has from DWP a letter to confirm this extension. He sent his form back well in advance of the deadline and sent by proof of posting on the 16th September. He got a letter from DWP dated 5th October saying his claim is closed and have decided to stop his claim for PIP and on 22ND October when his DLA comes to an end.
The letter dated 5th October added that they needed extra information but he as not respond. He has not received any letters up to today asking for anything.asking for further information, and he will get 28 days to send in.. Sending his for back on the 16th September to 5th October is not 28 days. This is wrong when the problem was at their end Something illegal going on?
He told me he telephoned the DWP who said there was a backlog in the sorting office. His claim form was stuck waiting to be logged showing as arriving after the deadline, when in fact they had the claim form which probably came on 17th or 18th, well in time. My friend is at fault for this. He has got proof of posting then they hassle this man by taking his DLA higher rate both care and mobility when common sense says otherwise. This man has serious heart problems and has had a quadruple bypass. Among other severe health conditions, the DWP was sticking by their decision and told he needs to do a mandatory reconsideration now which will take weeks. Something is not right here, and this could be illegal?????????
Can anybody tell me a way forward and if there is compensation for this needless stress on a sick man. He is vulnerable and is in distress already at this treatment. All his evidence was sent in that now-cancelled claim form. It is wrong and doing it to a man genuinely with health problems. Please, can anybody shed some light on this? Thankyou.

I'm sorry this has happened to your friend. To get any compensation would be a fight and I have only heard one person getting some, but that was after three years of problems. He has no choice but to put in his mandatory reconsideration with all the proof of posting - it isn't right, but there's no choice if he wants his benefits restored. I would also advise that he conacts his MP as soon as possible. From what I am hearing from other members who have contacted their MPs the DWP suddenly acts a great deal quicker.
Could also try ringing again and ask to speak to someone more senior and say again that you have proof it was received on time
Your friend can also put in a complaint at a later date, but I would put that on the back-burner until the claim has been restored.
