New style esa was created by Lisa
I have been on UC since April 2018 after being told I could not claim new style esa due to living in a full UC area. I had previously been employed full time but had been on ssp. I’m now receiving lcwra of UC but questioning if in fact I should of been able to claim new style ESA? And if I should of been is it worth pursuing after all this time ?

Hi Nasil

New Style and Contributory ESAare linked to your national insurance contribution record. To be entitled, you must have paid national insurance contributions over a certain number of years. Some awards of new style and contributory ESA are limited to 12 months.

To answer your question you need to check out your national insurance contributions in the last two years before you claimed.

I can't see any obvious reason why you could not have claimed NS ESA.

To have claimed NS ESA in 2018 you would need to have had a minimum of 50 weeks of NI Contributions in the two Tax Years 2015-16 and 2016-17, to make a claim now you would need your Contributions to cover the Tax Years 2016-17 and 2017-18, although UC Pays NI Credits these cannot be used for an NS ESA claim so depending on when you made your UC claim you may not have sufficient Credits now.

In general, UC will pay the same or more than NS ESA unless you have deductions from your UC that mean that you would receive less, if you did/were to claim NS ESA then the payment is deducted from your UC.
