I have been 'invited' to apply for PiP having been awarded indefinite award for DLA by tribunal in 2011. Back then the tribunal apologised to me and said that I should never have had to go through all that I did and it should never have gone to tribunal. Now I have received a PIP2 form telling me to apply for PIP or Im off DLA. Im pretty furious I must say having been so shamefully treated by the system before however...

Ive used your guideline for making PIP application and the local Welfare Rights Officer has now got the form and the replies my Carer typed out for me, which were painstakingly put together using the guidelines. She said she would use these replies to complete the form. I was worried when the advisor said that 92% of PIP applications were being refused, refused again at mandatory reconsideration but over 70% were 'winning' at appeal. This tells me that after all this time, absolutely nothing has been improved by the DWP. I had kept a copy of the ATOS report from my DLA application but the Welfare rights advisor said its no good as it is too old and they wont accept it. That is a terrible shame because it is an excellent report.

Ive also been told that assessments are around 16 weeks at present! The application does not start to the appeal Ive been told. Is all this correct? I honestly thought that I could send in the ATOS report, though it will be on the DLA file. I naively thought that having proven the veracity of my claim in the first place for DLA, this PIP changeover would be considered yes, but accepted almost immediately. Yes, stupid I know.

I would like to know if the information she has given me (as above) is correct please. Many thanks,

Hi Melrose

1. Everyone on DLA is being migrated across to PIP - so don't waste your precious energy being angry about it. It's not personal to you.

2. I don't know where the welfare rights officer got the figure that 92% of claims are refused. You can read the official statistics here - assets.publishing.service.gov.uk/governm...-to-january-2019.pdf

3. There are considerable differences between DLA and PIP and whether you had a lifetime award or not, it doesn't automatically mean you will be awarded PIP. However, many members here have had a successful change from one to another. Yes you can read lots of horror stories, and you already had a terrible experience, but one tends to hear less about the people who manage to get through it successfully.

4. Time of assessments - These can vary considerably from one part of the country to another. Some people are getting them through in as little as four weeks of their claim being processed.

5. Completing your claim form does not lead directly to appeal. You put in your claim, with your evidence, you are asked to a face to face, you have the appointment, the assessor writes a report, this is sent to a decision maker - and the decision is made. If you disagree with the decision, that is when you can decide to put in for a mandatory reconsideration. If the decision stayed the same, you could then go for an appeal and appeals are taking 45 weeks or more in most parts of the country.

Thank you for your reply. It did help deal with the initial shock and anger so thank you.

I went to see my doctor today and she was very supportive. She is writing a medical letter for me to submit with my application and said that she will tell them that I cannot cope either mentally or physically with an assessment. Do you think they will listen to her recommendation regarding assessment? And will it put me at a disadvantage not to do the assessment? The Welfare Rights Officer said mine would be a home visit which helps as I will not have to travel but, as my doctors says, I am worse now than Ive ever been, she is very supportive of me but Ive no idea if this will make any difference on the determination regarding the necessity of a face to face assessment. Some advice would be most appreciated.

Hi Melrose

So glad to hear that your doctor is writing a letter. This will not guarantee that you will not have a face to face assessment, but it will certainly carry a lot of weight. It's hard to say whether it puts you at a disadvantage if you only have a paper-based assessment - I know some people are happy with theirs and others are not as they haven't had the chance in person to give an account of themselves. However, the few people that do have paper-based assessments are usually delighted that they have not had to try and cope with the trauma of a face to face. You said that you went very carefully through the guide so you at least will have given them detailed information to base a decision - if they decide a paper-based assessment is the right route to go.
