Hi again gordon, in relation to my daughter sending back her form relating to a possible esa underpayment shehas finally received a reply after nearly 22 weeks. The reply is very sparse and informs her she is not entitled with their explanaition being that the amount of contribution paid exceeds any amount of income related due.
So that is basically all they have sent her and i wonder if you could maybe elaborate on what they are saying and tell me why a more detailed reply is not sent and if i should request one be sent on her behalf as i feel that when the shoe is on the other foot the want you to detail every single thing right down to toilet habits but do not extend the curtesy when replying to claimants.

Thanks again.

This is how the DWP worked out her entitlement;

First, does she have a partner working for 24 or more hours a week, if she does then there is no entitlement to ESA(IR) and only her ESA(CB) is payable.

If the ESA(IR) is potentially payable then they work out what she could receive, this amount is will include her Personal Allowance, the Component (WRAG or SG) and any Premiums that are payable.

Next, they deduct any income, notional income from savings and her Contribution Based ESA (Personal Allowance and Component).

If the calculated ESA(IR) is greater than all of the deductions then the difference is payable in addition to her ESA(CB)

If it is less then just the ESA(CB) is paid.

I don't know her circumstances so I can't do any calculations but you could try putting her information into one of the online benefit calculators.

thank you so much for the speedy reply, my daughter had no partner (she has never had a partner and never been married due to her adhd/aspergers syndrome she has always found relationships of any nature very difficult which as a mother deeply saddens me) savings negligable and same for any other income.

i will try your recommendation of an online calculator but im 72 and not very confident as how to use one that involves historical information so if you have information on which one would best suit i will be very gratefull.

Thank you.

Hi V Murphy

The government's own benefit calculator is a good one to use
