Hi all,
I was recently awarded with the Severe Disability Premium upon appeal, with this being backdated to May 2018. However, I would just like to clarify a matter regarding the dates.
Whilst my claim for Employment and Support Allowance (ESA) was made in August 2017, it went through a protracted appeals process, with a tribunal in April 2018 and then, after a further delay, the claim being awarded in my favour by the DWP in May 2018. In addition, my claim for Personal Independence Payment (PIP) went through a similar appeals process, with a claim being made in February 2018 but not actually being awarded until December 2018.
With this in mind, I am therefore wondering whether the SDP award that I have been given should be backdated from the commencement of my PIP claim, considering that I had already applied for ESA several months prior and, indeed, as part of my ESA claim being awarded I was backdated payments from November 2017 (the time in which I had a medical assessment).

The SDP only applies to ESA and is nothing to do with PIP and therefore it would be awarded from the dates you have been given.

I'm afraid that BIS is not entirely correct.
I assume that you were not claiming DLA before your PIP award or if you were that you did not have a Medium or Higher Rate Care award.
So, ignoring the appeals as they simply revised the ESA and PIP claims to be awarded from the date that they were made, the SDP became payable from the first day that all three of the following applied.
1. You had an award of ESA and were receiving or were entitled to receive Income Related ESA.
2. You had an award of PIP Daily Living
3. You met the criteria for payment of the SD Premium, namely that you lived alone or were considered to be living alone and no one receives Carers Allowance against your PIP award.
From your post and without knowledge of whether you had a DLA award or whether you qualified for the Premium itself I think that the Premium should have been payable from February 2018 when you made your PIP claim.
