Good afternoon, can you advise me please.

I think this is incorrect but is it true that dla can be refused on the basis thay a child takes medication for a condition? In this case l am talking about melatonin for a child with asd. Surely the fact they are on it is evidence of sleeping difficulties in itself?

I've been looking up online but cannot find anything about this, or the relevant guidance on this .

Many thanks.

Hi Clare

I don't know where you got that information from, but no child is turned down for DLA just because they take medication. If they were turned down it would be for a different reason.

Thank you for your reply. I too find this really strange. I'm trying to find out for someone else who says this is the sole and only reason for refusal..that their sleep issue is controlled by medication so therefore no night time needs?

Where the claimant is receiving treatment or medication there is always going to be an assumption that there is. at the least, some reduction of the symptoms, we all know that this does not always happen so has the person explained that there are still night time care needs?

Also, Children's DLA compares the issues that the claimant has with those that a healthy child of the same age would suffer from. You don't mention the age but is it possible that the child in question has problems overnight that are not significantly different from those a healthy child might suffer?
