SDP Gateway was created by Tinol
Hi all,
I would appreciate some advice regarding the SDP Gateway, which presently prevents those receiving the Severe Disability Premium from transferring over to Universal Credit, regardless of a change in circumstances. It is my understanding that this arrangement will cease in January 2021.
As it stands, I am receiving ESA (WRAG), PIP and the SDP on top of these. In addition, I am also receiving housing benefit through my local authority. Recently, I have been contemplating moving to a different area, however this might not be until 2021 now. Would relocating prevent me from submitting a fresh claim for housing benefit through a different LA, once the Gateway had been lifted?
Many thanks

Hi Alex
The GovUK web site states 'The SDP gateway will be removed in January 2021 with SDP claimants who experience a change in circumstances being eligible to claim Universal Credit after that date'. www.gov.uk/government/publications/unive...ility-premium-claims.
As you have rightly stated, if you move to a different local authority then you would have to apply for UC unless you are already in receipt of a SDP, in which case you would stay on legacy benefits but this may change in January 2021.

Gary,
Following the recent legal action launched by Leigh Day (see here: www.leighday.co.uk/News/Press-releases-2...ability-Premium-laun) I wonder if this deadline will be extended?

Just to be clear, there is no "deadline", this is a policy document, the legislation that enables the SDP Gateway has no End Date and would have to be repealed to allow a claim for Universal Credit.
The date in 2021 was part of a plan for the implementation of UC that was set out by Theresa May's Government, the project was already in dire problem last year when only 17 transfers of the required 10,000 for the Pilot migration had been carried out after more than six months of work and has been further delayed by the pandemic.

Hi Alex
Nothing would surprise me, but at present I have not heard anything, keep an eye on B&W's news letter for up to date information. If you have not yet sighed up for a free copy then I would do so.
