Tribunal PIP Question was created by SirSupaDupa
Hi there,
So i'm just wondering whilst i'm waiting for my MR decision to come through, in case it doesn't go well, the next stage would be an appeal/tribunal from my understanding my question is:At the tribunal do they request all medical records from my GP/Hospital or do i have to request them to do so on my behalf?
The things is i don't want all my medical records looked at anyway as some of things are unflattering and may go against me, which is why i sent in my best evidence to PIP rather than sending everything, and plus it's like 800 pages over 5 years lol i'm sure no one wants to read it all.

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi Sam
The tribunal panel looks at the information you have provided and what the DWP says. They don't ask to access the claimant's whole medical records. If they think there is not enough information to make a decision they might ask for some more information, but this is very rarely done and you would know about it. It still wouldn't be all your records.

"The tribunal panel looks at the information you have provided and what the DWP says".
Does that mean they look at what i sent to PIP AND MR as in PIP provide it for them? or would i have to resend all the copies myself to tribunal?

Hi Sam
You can read about the whole process in the Guide to PIP Appeals - www.benefitsandwork.co.uk/help-for-claimants The DWP provides a pack that they submit to the panel which will include the information you submitted.
