I’ve finally got the form - I’ve received the ‘review’ edition. Do you know if they will take into account my previous award and evidence when reviewing my claim, as unfortunately I don’t have nearly as much evidence considering since my tribunal award started covid just hit, and it’s only been a few months since things got back to normal. Also is it correct, for the review form the DWP are expected to prove how the condition has improved if they try to reduce the award, rather than trying to prove why you should be awarded in the first place?

Also a couple more questions, is the likelihood of needing an assessment the same as a new claim, and what will happen to my payment if the review isn’t processed by October when the current award ends?

Hi Kieran

Glad you have the form.

Your previous evidence should be on the system for them to access. In the current circumstances, many claimants find that they don't have any 'new' evidence. You can only send anything you have and refer to previous documents as appropriate. Do look at the guide for completing the form.

Yes, the DWP are expected to explain their reasoning for reducing an award. Are these reasons accurate? There will be plenty of people who say no.

The majority of claimants have a telephone or face-to-face assessment at review time.

Some people have been offered a last-minute extension, but those who were awarded by Tribunal in particular often find the money stops, but it will be backdated if a new award is given.

I thought that would only apply if you are sent through the new claim route. That’s a particular concern as my award ends in 4 months, and the average review period is 5-6 months. It would have helped if I didn’t spend over a month to even get the form in the first place.

Hi Kieran, that's the DWP for you. We had to bankroll our daughter when her money stopped as Covid started. Her form was already in but they didn't have the decency to extend her award during the wait for processing as they did the people whose forms were due in just a few weeks later. Not everyone's got a bank of Mum and Dad so we though it extremely unjust. Never mind robbing disabled pensioners...The only thing you can do is start involving your MP now, they're not all helpful but if you don't try you won't know. And if they don't help ensure your review is done before payments stop, well you'll be able to tell everyone in the constituency who not to vote for eh?
best wishes,
Denby
