Forced migration rules was created by davis
OK just read email and it said that forced migrations will be stopped if no changes . I have read the legislation and said that if a there is a change of circumstances but you are in the same area (like moving home) this does not class as a change. Have i got this right i will be moving home but still in the same area it said that this is not classed as a change in circumstances but what if they say it is and try to migrate me over.what can i do then. I'm just asking just in case i misunderstood what i read . Thank you in advance

Hi davis
If you move within the same local authority and have to claim help with your housing costs then you will stay on legacy benefits. If you are told otherwise the you can appeal the decision, at that stage I would advise you to seek help from your local Welfare Rights Organisation; advicelocal.uk
If you move to a different LA and need to claim help with your housing costs then that will be a change of circumstances and you will have to apply for UC to get the housing element.
If you move to a different local authority and you do not need to claim help with your housing costs you can still stay on IR ESA, if you are on IR ESA.
