IR-ESA to UC, Please Advise, Journal Entry, (it may help others too)

Hi I am in the process of claiming/migrating from the support group IR-ESA to UC I received a journal entry today. I'm not fully sure if it is just part of the process or if I am meant to take action. Could someone give their view on this? I am a little confused. Regards Paul STATEMENT RECEIVED --- Some other benefits can affect how much Universal Credit you get. You and your partner can continue to claim these benefits, but we will adjust your Universal Credit payment. Your statement shows you how we do this. Our records show that XXXX XXXX XXXX XXXX is getting: Employment and Support Allowance If you think this is wrong If XXXX XXXX XXXX XXXX no longer gets this benefit they should contact the office they claimed it from. Tell them XXXXXX XXXXXXX is now getting Universal Credit and to update their records.

Hi Paul,

It sounds like you may have had a mixed award of ESA, which was made up partly of contribution-based ESA and a top up of income-related ESA. Many people are finding this out at the point of migration, having previously been led to believe that they are solely receiving IR-ESA. You could reply in your journal to query if it contribution-based ESA they are referring to. Or you could ring ESA but it can be hard to get through.

There is some info about this issue in the ESA to UC migration guide www.benefitsandwork.co.uk/?dlp=688287e638103 - the Hassan example on page 32 shows how the migration of mixed ESA claimants happens in practice and there is a bit more on page 52 as well.

I also wrote something about this for a recent newsletter here www.benefitsandwork.co.uk/?dlp=688287e638103 because of the number of cases of mysteriously appearing contribution-based ESA.

If you have a scroll through the forums, you will also find quite a few other people in this boat so that might help you get an idea of how the process has worked for them.

Firstly, thanks for blanking out my name I missed at the end of my message
Can I ask a couple more questions? Hope that's ok.

1) As far as Contribution Based goes, I was under the impression that anyone on that would be moved to UC + New Style ESA.
I read somewhere that it was related to contributions over the last 3 years.
I have been in Income-Related ESA only and expect to be moved over to UC alone; this was my impression.
Please advise, if possible?


Brief History Me,

Spinal Injury back in 1998 -
I claimed Income Support and then claimed Incapacity Benefit alongside it, or I claimed both together; I'm not sure which. A long time has passed.
From Sept 2012 - ESA claimed / ESA Income-Related / Support Group

For me, I don't understand why they think I am still claiming ESA. Is it not auto-cancelled out once you make a UC Claim?
I understand you are saying if it were receiving contribution-based, then this would affect the award and that might be why they are using it in the calculation, but by how many years I have been receiving ESA, not once mentioned, etc, I just can't see it...?

Lastly, if this is the case, what does that mean, implications..
Will I receive an award of ESA New Style and UC combined?
Will I receive the same income?
Does receiving Contribution-Based affect other things? - Dentist, prescriptions, etc, sorry, thinking ahead.

Moving Forward

I am going to ring ESA and ask about Income Related, Contribution, etc, go from there, maybe then add to the journal.

Hi Paul

We cannot answer your queries as we do not have all the facts.

We do quite often come across claimants who had no idea that they were in receipt of both IR-ESA and CB-ESA, the benefit increase letter DWP send out each year is not very clear as to which type of ESA you are receiving, if you received Disability Premiums then that would be IR-ESA but your underlying benefit may be CB-ESA with IR-ESA top up.

If you are put in NS-ESA then yes you will receive both NS-ESA and UC. Remember NS-ESA is paid fortnightly whereas UC is paid monthly.

NS-ESA will be deducted from your UC applicable amount.

Gary, Thanks...

I rang ESA, and the first person I spoke with didn't fully answer what I was asking. He also stated I had received a last payment on a date I had not received, and the figure he gave was incorrect when compared to my last payment received.

He said he would send out a letter to explain, and said he would get someone to call me back on Monday, too.

I think I have been caught off guard as I've been on IR-ESA since 2012, and in no letter has it ever stated I received CB-ESA as far as I can remember. The more I read, this is happening to quite a few, so I will await the call.

I will update this post once I know what is going on; the info may help others.

Tnx for the reply

It was too do with CB NS ESA, I was unaware of I was in receipt of this.

Moving forward after speaking with an ESA chap, escalated..
He explained it all. He also made me aware the last ESA payment was a run on and wouldn't be taken into account by UC ..
So when I receive my first UC payment, I need to make sure that it the case, only the payments after that run on payment should be taken into account...

Gary, if they do take more into account by mistake, what should I do, who should I advise, can you advise please...?

Overall I'm happy claim going through correctly.

Also I received a call from NS ESA today, they made me a tel appointment for the claimant commitment..
Now with my migration if I am too understand correctly, no fit notes, no assessments, no medical evidence is needed, this should just be, mum agree omg to advise of any change of circumstances... An I correct in thinking this..?
