NS-ESA assessment rate when receiving occupational pension.

Hello, I’d be grateful for some advice please.

I applied for NS-ESA on 1st June and was paid at the standard £92.05 weekly rate for the assessment phase. However, it took until January for the WCA to take place due to their standard delays and the medical assessors cancelling appointments.

I’ve now been placed in the support group and have been given back pay at £48.50 a week backdated to the end of August (when the 13wk assessment phase would have ended).

However, what bothers me is the fact that I have an ill health occupational pension - which I declared from the outset. The DWP have now reduced my entitlement to £11 a week from 22/1/26 which aligns with deductions for my pension. BUT, am I entitled to the higher sums they paid me during the assessment (£92.05 for 13 weeks and then £140.55 backdated to late August)? Should they have reduced these payments accounting for my pension income?

It would be fantastic if I was allowed to keep it, but I’m concerned that they might chase me for an overpayment at some point. It’s a lot of money.

Are you able to explain how it works please and advise if I need to take action.

Hi Margole

Are you saying that they failed to deduct the pension payments from your ESA during part of your claim? If so that is a mistake and I would phone the ESA section to enquire why.

Yes, they have paid me £92.05 from June to the end of August, then increased this to £140.55 a week from the end of August to 22nd January (via a lump sum back pay). Then, from 22nd January they have decreased the total amount to £11.39 a week to account for my pension.
Am I right in thinking that I will be required to pay back the excess right back to the start of my claim in June? How do they recover it as it’s a substantial sum.
For the record, I provided pension details at the outset.

Hi Margole

I think NS ESA is classed with UC as far as DWP official error is concerned which means that you will have to pay it back.
