Hi
I made a UC claim for my severely ill son. He runs a small business from bed with my husband helping him. He was put in the LCWRA group for credits only ESA.
UC called today to discuss reporting earning (he spoke with my husband on behalf of my son) and was told they had decided my son was 'not gainfully employed.'
This is what is in his journal (copied below)
:We’ve looked at details of your self-employment and have decided that you are not ‘gainfully self-employed’.
What this means for you
To keep getting Universal Credit, you must continue to keep your commitments. They are listed in your Universal Credit account. This may include looking for and being available for work.
You still need to report any self-employed income and expenses to us on the last day of each assessment period. For you this will be the 11th of each month.
This is so we can work out how much Universal Credit we need to pay you. You need to do this even if you have no income.
If you do not tell us your self-employed earnings at the end of your assessment period, your Universal Credit payment may be delayed or stopped.
He didn't seem to understand about the 'support group' my son is in on the credits only ESA being automatically made over to LCWRA for UC (we were told by UC on the phone that this is automatic - is it?)
I'm not sure what position my son is now in as being seen as 'not gainfully employed.' I'd be grateful for advice as we have only a month to send for a mandatory consideration which I've not done before.

This is actually some good news. Most self employed claimants would love to be declared Not Gainfully Self Employed as this means that the DWP can't impose the Minimum Income Floor ( MIF ) which is an artificially high level of income.
All claimants with LCWRA are exempt from the MIF.
