Two years back dated DLA was created by The Dim Reaper
A short lesson from a recent experience.
A child with very significant care needs had a disability benefit claim refused. Anyone involved in the day-to-day care knew the level of supervision required was extremely high, yet the original application was poorly prepared and lacked the detail needed to meet the legal tests used by decision-makers.
The advice relied upon at the time came from someone who appeared knowledgeable about the process but was not legally trained. Unfortunately, that showed in the way the claim had been completed.
The case eventually went to tribunal. Once the evidence was properly organised and the relevant legal criteria were clearly addressed, the tribunal had little difficulty recognising the level of care required and the claim succeeded at the highest rate, with backdated payments.
While the outcome was ultimately correct, the process took nearly two years longer than it should have.
The moral is simple: disability benefit law is technical. The system operates on specific legal criteria, not just common sense or personal opinion. If you are seeking advice about a claim, make sure the person advising you actually understands the legal framework. Well-meaning but unqualified advice can cost a great deal of time, stress and delay.
