Hi All.
I have a query about PIP backpay.
I have been getting PIP for years - lower rate for DL & Mobility. I recently had an assessment on the phone as a result of a regular 2 year review of my award. Great news - they continued the lower rate for DL and awarded me the higher rate of mobility. A huge thanks to the Benefits and Work team - what a great service you do!
14 May 2025 - review form sent to me. Completed and sent back.
2 Mar 2026 - phone assessment.
Their decision letter dated 8 March 2026 stated: " (enhanced rate for mobility) You can now get this from 14 May 2025 to 1 March 2029." "We may owe you some money. You will get a letter from us to tell you more about this."
I rang the PIP line this week to enquire about the possible backpay and was told there was nothing on the system to indicate I was owed any back pay, that it is at the discretion of the decision maker to decide who gets back pay and that I could ask for a Mandatory Reconsideration if I didn't agree with the decision.
I am confused, I thought the letter indicated that I would get back pay? (It was clear from the form I completed and my phone assessment that my health had worsened since before their review date letter of May last year. If I had not been due a review I would have asked for one due to my worsening health). Should I ask for a MR? Does this trigger a MR into the whole decision of rates or can it just apply to the backpay issue? Is there a 1 month timescale which I may miss as the decision letter was dated 8 March?

I would ring again - as you will get a different person. The decision letter clearly says that it is dated from the 14 May 2025 - and therefore you are clearly owed money! Why would you put in for a Mandatory Reconsideration. I would ask them when you can expect to put in a letter. How can you put in an MR when you haven't received a letter and you are only being told over the phone. If you don't get any joy - ask for a call back from a case manager. If you don't hear back within a week I would put in an MR. ERven if you miss the one month deadline - you have a further 12 months to put in a late MR and you have the perfect excuse why it is late - because they failed to send you a letter about the money you are owed. I know back pays are down to the discretion - but they have no reason for nearly 10 months money. It wasn't you fault that they took so long to make a decision.
