Is this a valid change of circumstances that needs reporting? was created by star_88
Dear team,
I hope you are all fine,
I have numerated my paragraphs just in case you need to quote them.
So,
(1) I’ve been receiving LCWRA for some years and have not had any reassessment since I was awarded, however as I want to be fully ready for the job I want by the time my LCWRA award ends I would like to have completed by then the course/qualification that will allow me to get such job.
(2) The course/qualification is a Distance -not in person- Level 4 Diploma given by a UK Chartered Institute for which the tests/exams can be sat online/remotely, and it’s not a university course: I completed a university degree ages ago so no need to go back to Uni again, thanks!
(3) I got copies, via a Subject Access Request, of the WCA questionnaire I filled and of the UC85A Medical Report Form: Neither in the UC85A Medical Report Form nor anywhere else can I see how many points I was given for each function/activity.
(4) In the UC85A Medical Report Form the healthcare professional that assessed me stated, however, the following:
“I advice that the client meets the criteria for Limited Capability for Work and Work Related Activity” as they are suffering from some specific disease or bodily or mental disablement and, by reasons of such disease or disablement, there would be a substantial risk to the mental or physical health of any person if they were found not to have limited capability for work and work-related activity”.
(5) Each of the 6 Units of the course/qualification I mentioned at (2) can be approved/passed by sitting a remotely invigilated online exam that requires a minimum of 60 hours of study for each of the 6 textbooks: But due to my mental health conditions (the ones the healthcare professional describes at (4) above) I have required at least 8 months so far to be able to understand/read 80% of the content of the textbook of Unit 1: That means, in other words, that my disabilities are still impacting my functions/functionality negatively.
(6) Considering the difficulties I am still having, it’s clear it will take me ages to complete this course/qualification.
(7) I don’t know whether I have to report a change in circumstances RE: This course/qualification as I don’t have a clue if this is a valid change that needs reporting: This is because I haven’t even completed reading/understanding the first textbook yet and I have not sat the test/exam yet either and all because my mental health illnesses have delayed my ability to do both.
(8) I also cannot find valid information on reporting change of circumstances for this specific course/qualification after a Google search and even after reading the “Permitted Work And Working While On Universal Credit Due To Sickness Or Disability” produced by you (benefits and work).
(9) Is there a rule that states I need to report to the DWP/LCWRA that I am doing this specific course/qualification even though my disabilities are still impacting negativity my ability to complete it? I am not getting any private or government loan to afford it by the way, I am in fact using my benefits payments to pay for this qualification.
(10) And, if this change doesn’t need reporting, I wonder: How will the DWP react in the future if they get to know I have completed this course/qualification (with/after the enormous difficulties and delay this will involve and is involving already) whilst getting my LCWRA award but that I never reported to them that I was doing it?
(11) I don’t want to get in troubles with the DWP and be fined and/or prosecuted if I don’t do things by their book (and I don’t even know what the rules are on this regard! LOL!) but at the same time I know assessors can be ruthless and/or evil and after a reassessment can leave me without my LCWRA award which I need so much to be able to pay for this qualification.
Your help on addressing my questions/doubts at (7), (9) and (10) above will be extremely appreciated.
Kind regards,
Star.

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi star_88
You have a copy now of your ESA/UC50 so does the ability to do this course contradict any of the health related statements you made therein?
Only you know if your health has improved and your symptoms have abated.
In the future the DWP may look for indications of this via medical reports and changes to prescribed medication.
