Hello. Please can you help me. We are claiming HB. Some time ago the council when asked confirmed we would not have to migrate to UC. I will paste their confirmation. But today we received a migration letter. First question, were the council wrong in what they said? My husband is 72 and severely disabled with Alzheimer’s. I too am registered disabled with a severe mental and physical health condition. 2nd question, if we do have to migrate, do we have to have one of those health assessments? Both of us are too ill to work and claim the highest rate of P.I.P. I am under state pension age and am in the support group for ESA. Here is the email from the council:
Thank you for your enquiry.
Your benefit entitlement will not need to be amended as you are part of a ‘Protected Mixed Age Couple’ and have been prior to the change in legislation on 14th May 2019. There has been no changes and no gap in your claim. Therefore yourself and your husband you will not be asked to migrate to Universal Credit.

This migration letter could have been sent in error. I would contact the Council to confirm that what they said previously still holds.
I would also phone Citizens Advice Help to Claim as they are usually very good with these issues. Here is how to :-
Call our Help to Claim phone number
You can contact an adviser through our free Help to Claim phone service. Advisers are available 8am to 6pm, Monday to Friday:
England: 0800 144 8 444
Scotland: 0800 023 2581
Wales: 08000 241 220
If you'd like to speak to a Welsh language adviser, call the Wales number.
If you need an interpreter
You can get help in a language that isn’t English or Welsh. You should:
call the Help to Claim number for the country you live in
tell the adviser you need an interpreter
An interpreter will join the call and they will interpret for you and the adviser.
If you can't hear or speak on the phone
You can use our text relay or British Sign Language (BSL) video call service to speak with us about your Universal Credit application
