UCLCWRA - updating before awarded was created by JenBiddy40
Hi.
I started the UC LCWRA process in January when unwell and submitted my application in March. I have not heard anything at all yet but would like to check please if I need to update this, how would I do it and would it affect the rate that I receive (I believe currently the old rate).
Also, with UC LCWRA is it different in terms of, does each activity need to be done repeatedly, or does doing it just once count? My reason for asking is that I am managing to sit upright for longer than I previously was so think I possibly need to update? For example previously I could only manage around 30 minutes but now I can manage between an hour to two hours on some days. Although not if it means repeatedly, as I can only do my set time and then have to rest.
Thank you.

Hi JenBiddy40
The WCA descriptors regarding standing and sitting are outined below:-
How to explain problems with: Standing and sitting
The descriptors: what the law says you score points for
2. Standing and sitting.
(a) Cannot move between one seated position and another seated position located next to
one another without receiving physical assistance from another person. 15 points
(b) Cannot, for the majority of the time, remain at a work station, either:
(i) standing unassisted by another person (even if free to move around) or;
(ii) sitting (even in an adjustable chair); or
(iii) a combination of (i) and (ii),
for more than 30 minutes, before needing to move away in order to avoid significant
discomfort or exhaustion. 9 points
(c) Cannot, for the majority of the time, remain at a work station, either:
(i) standing unassisted by another person (even if free to move around) or;
(ii) sitting (even in an adjustable chair); or
(iii) a combination of (i) and (ii),
for more than an hour before needing to move away in order to avoid significant discomfort
or exhaustion. 6 points
(d) None of the above applies. 0 points.
However there are a lot of qualifications to the above and you or your carer really need to read pages 59 to 63 of this BenefitsandWork guide :-
www.benefitsandwork.co.uk/?dlp=6a43b7eb08df2
I would also advise you to keep a diary of how your disability affects your daily life. You will then be able to answer the questions more accurately and it will come in handy to quote to the assessor when you have the WCA.
Do you know which HAAS company is responsible for your WCA? If so you could phone them about processing.
Let us know how you get on.
