can they still put you in the 'work category'? was created by sian
Hi all,
My hubby and i are both disabled, both getting DLA but he's on higher care and i'm on middle. He gets pension credit and i get IB. I also get 'carers allowance' for him... does this mean that when i'm switched over to ESA, if i fail the medical would i still be put in the 'Work' group or does the fact that i'm my husbands 'carer' stop that??

If you fail the ESA medical then you have three choices; you can appeal the decision, move onto JSA, or become economically inactive. The fact that you are receiving CA does not affect any of these options.
In all three case you can still receive CA providing that you are able to demonstrate that you still meet the requiremnts fro getting CA.
Don't forget that CA is an overlapping benefit, so it possible that you might not receive any additional money for CA, depending on the benefits you are receiving.
